FIRE PROTECTION: Provides relative to the head of the fire protection bureau in the city
of Thibodaux
1 AN ACT
2To amend and reenact R.S. 40:1563(C)(2)(a), relative to the city of Thibodaux; to provide
3 for the designation of the head of the fire prevention bureau of the city; and to
4 provide for related matters.
5 Notice of intention to introduce this Act has been published
6 as provided by Article III, Section 13 of the Constitution of
7 Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 40:1563(C)(2)(a) is hereby amended and reenacted to read as
10follows:
11 ยง1563. Powers and duties generally; use of deputies; responsibilities of local
12 governing authorities with fire prevention bureaus; open structures and
13 process structures; fees

17 (2) The local governing authority may properly establish a fire prevention
18 bureau by special ordinance and accompanying resolution as provided in this Section
19 and a fire prevention bureau thus established may apply for certification by the fire
20 marshal to perform inspections on behalf of the fire marshal solely through adoption

1 of the special ordinance which conforms to the following requirements which are
2 applicable to existing fire prevention bureaus:
3 (a)(i) The fire prevention bureau must shall be headed by a chief of a fire
4 department or a person designated by the chief of a fire department.
5 (ii) Notwithstanding the provisions of Item (i) of this Subparagraph to the
6 contrary, in the city of Thibodaux, the fire prevention bureau shall be headed by a
7 person designated by the local governing authority.

Abstract: Provides that the local governing authority designates the head of the fire
prevention bureau of the city of Thibodaux.
Present law provides that the local governing authority may establish a fire prevention
bureau, and the fire prevention bureau may apply for certification by the fire marshal to
perform inspections on behalf of the fire marshal. Present law further provides that the fire
prevention bureau must be headed by a chief of a fire department or a person designated by
the chief of the fire department.
Proposed law retains present law but provides that, instead of the chief of the fire
department, the local governing authority shall designate a person to head the fire prevention
bureau of the city of Thibodaux.
