HOUSE BILL NO. 480

MEDICAID:  Provides for employment of people ages sixteen and over as direct support
professionals for Medicaid waivers and services
1	AN ACT
2To enact Part VII of Chapter 5-E of Title 40 of the Louisiana Revised Statutes of 1950, to
3 be comprised of R.S. 40:1258.1, relative to the employment of direct support
4 professionals for Medicaid waivers and state plan services; to provide for the
5 employment of a person sixteen and older as a direct support professional, direct
6 support worker, or personal care attendant; to provide for definitions; and to provide
7 for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  Part VII of Chapter 5-E of Title 40 of the Louisiana Revised Statutes of
101950, comprised of R.S. 40:1258.1, is hereby enacted to read as follows: 
11	PART VII.  DIRECT SUPPORT PROFESSIONALS
12 §1258.1.  Employment provisions  
13	A.  Any person, sixteen years of age or older, may be employed as a direct
14 support professional, direct support worker, or personal care attendant for Medicaid
15 waiver services including but not limited to the New Opportunities Waiver,
16 Residential Options Waiver, Children's Choice Waiver, and Community Choices
17 Waiver, Medicaid services such as the Early and Periodic Screening, Diagnostic, and
18 Treatment program, and personal care and long-term personal care services.
19	B.  For purposes of this Section, "direct support professional", "direct support
20 worker", and "personal care attendant" mean any person who provides care or

1 support to persons with intellectual or developmental disabilities, including but not
2 limited to assisting with personal tasks such as hygienic maintenance, daily living
3 support, and healthcare monitoring.

Abstract:  Allows a person 16 years of age or older to be employed as a direct support
professional, direct support worker, or personal care attendant for certain Medicaid-
related services.
Proposed law allows any person, 16 years of age or older, to be employed as a direct support
professional, direct support worker, or personal care attendant for Medicaid waiver services
and Medicaid services.
Proposed law includes but is not limited to the following Medicaid waiver services and
Medicaid services:
(1)New Opportunities Waiver.
(2)Residential Options Waiver.
(3)Children's Choice Waiver.
(4)Community Choices Waiver.
(5)Early and Periodic Screening, Diagnostic, and Treatment program services.
(6)Personal care services. 
(7)Long-term personal care services.
Proposed law defines "direct support professional", "direct support worker", and "personal
care attendant".
