WEAPONS/FIREARMS:  Provides relative to the illegal possession of stolen firearms
1	AN ACT
2To amend and reenact R.S. 14:69.1(A)(2), relative to illegal possession of stolen firearms;
3 to provide relative to an affirmative defense; and to provide for related matters.
4Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 14:69.1(A)(2) is hereby amended and reenacted to read as follows: 
6 ยง69.1.  Illegal possession of stolen firearms

9	(2)  It shall not be an affirmative defense to a prosecution for a violation of
10 this Section that the offender had no knowledge that the firearm was the subject of
11 any form of misappropriation.

Abstract:  Amends an affirmative defense to the crime of illegal possession of stolen
firearms in regards to the offender's knowledge of the firearm's legality.
Present law (R.S. 14:69.1) provides for the crime of illegal possession of stolen firearms and
provides for penalties.
Proposed law retains present law.

Present law (R.S. 14:69.1(A)(2)) provides it shall be an affirmative defense to prosecution
that the offender had no knowledge that the firearm was the subject of any form of
misappropriation.
Proposed law amends present law to provide that it shall no longer be an affirmative defense
that the offender had no knowledge that the firearm was the subject of any form of
misappropriation.
