STATE AGENCIES:  Provides for the collection of fees associated with facilitating an
electronic signature or authorization
1	AN ACT
2To amend and reenact R.S. 49:316.1(A)(3), relative to state agencies; to provide relative to
3 electronic payments; to provide relative to fees associated with electronic signatures;
4 to provide for the authorization of the collection of fees by third-party solutions; and
5 to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 49:316.1(A)(3) is hereby amended and reenacted to read as follows: 
8 ยง316.1.  Payments by treasury approved credit cards, debit cards, and other forms of
9	electronic payments; authorizations; contracts; fees

12	(3) For the purpose of this Section, "third-party solution" shall mean a
13 company that any of the following:
14	(a) A company that provides a software application, a gateway, or both to
15 capture credit card and any other forms of electronic payments for processing by a
16 merchant services acquirer.
17	(b) A company that facilitates electronic signature or authorization.

Abstract: Provides for convenience fees for use of electronic signatures.
Present law provides that the state may accept credit or debit cards for the payment of taxes,
fees, licenses, fines, penalties, interest, etc. Provides for a convenience fee for the use of a
card for payment.  Provides for the convenience fee to be charged by a third-party solution
and paid by the consumer, upon the consumer's approval.
Proposed law retains present law and adds convenience fees for the use of electronic
signatures or authorizations to be charged by a third-party solution and paid by the
consumer, upon the consumer's approval.
