ENROLLED 2023 Regular Session HOUSE CONCURRENT RESOL UTION NO. 120 BY REPRESENTATIVES DAVIS, BISHOP, BROWN, BUTLER, COX, FISHER, HILFERTY, HORTON, HUGHES, ILLG, JORDAN, LAFLEUR, LARVADAIN, MCFARLAND, NEWELL, PIERRE, PRESSLY, THOMPSON, AND WILLARD A CONCURRENT RESOL UTION To create a subcommittee to be comprised of members of the House Committee on Health and Welfare, the Senate Committee on Health and Welfare, the House Committee on Insurance, and the Senate Committee on Insurance to study Louisiana's efforts to prevent, treat, and cure nonmelanoma skin cancer, to develop recommendations for continued improvement in preventive and treatment practices as it relates to nonmelanoma skin cancer, and to report an initial and final findings. WHEREAS, Louisiana has the eighth highest occurrence of nonmelanoma skin cancer in the United States; and WHEREAS, on May 15, 2022, Governor John Bel Edwards issued a proclamation urging Louisiana citizens to learn about risk factors, preventative strategies, and available treatment options, including but not limited to Mohs or micrographically oriented histographic surgery, topical chemical treatments, and image-guided superficial radiotherapy; and WHEREAS, public policy should protect and embolden the unique relationship between a patient and his physician in order to promote the ability to prevent, treat, and cure occurrences of nonmelanoma skin cancer in a timely and effective manner; and WHEREAS, healthcare providers are best situated to work with their patients to determine the most effective and efficient treatment options, including but not limited to reaching a determination of which treatment options are medically necessary; and WHEREAS, medical research shows that certain preventive and treatment options may be more effective and efficient than other types of treatment based on the diagnosis and severity of the patient's nonmelanoma skin cancer; and Page 1 of 3 HCR NO. 120 ENROLLED WHEREAS, a result of research, development, and innovation, patients and healthcare providers have several options to consider to treat nonmelanoma skin cancer, such as image-guided radiotherapy and topical chemical treatments, which may be more effective, less invasive, result in fewer side effects, and require less recovery; and WHEREAS, early detection and effective treatment options are shown to substantially reduce the mortality rate of nonmelanoma skin cancer, the recurrence of the disease, the physical and health burden of a patient, and the overall costs associated with treatment; and WHEREAS, this subcommittee builds on the foundation of the proclaimed "Nonmelanoma Skin Cancer Awareness Week" on May 15 to May 21, 2022, by providing public officials an avenue to identify policy opportunities to assist, support, and improve Louisiana's ongoing battle against this deadly disease. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby create a subcommittee of the House Committee on Health and Welfare; the Senate Committee on Health and Welfare; the House Committee on Insurance; and the Senate Committee on Insurance to study the practices and policies related to educating, preventing, and treating nonmelanoma skin cancer for Louisiana residents. BE IT FURTHER RESOLVED that the subcommittee shall be composed of twelve members from the following committees: (1) Three members from the House Committee on Health and Welfare. (2) Three members from the Senate Committee on Health and Welfare. (3) Three members from the House Committee on Insurance. (4) Three members from the Senate Committee on Insurance. BE IT FURTHER RESOLVED that the speaker of the House of Representatives shall appoint members from the House committees on health and welfare and insurance, and the president of the Senate shall appoint members from the Senate committees on health and welfare and insurance. BE IT FURTHER RESOLVED that the subcommittee may call upon the staffs of any department, agency, or official of the state for data and assistance and all such departments, agencies, and officials shall cooperate with the subcommittee, and the subcommittee may request and utilize the assistance of any and all public and private Page 2 of 3 HCR NO. 120 ENROLLED sources, including but not limited to residents, elected officials, medical experts, scientists, and nongovernmental organizations. BE IT FURTHER RESOLVED that the subcommittee shall study all of the following: (1) Existing awareness, detection, and treatment programs and procedures available to Louisiana residents relative to nonmelanoma skin cancer and, if applicable, the efficacy of such programs and procedures. (2) Accessibility of treatment options, including coverage by insurance providers, for available programs and procedures related to the prevention and treatment of nonmelanoma skin cancer occurrences. (3) References and case studies, if any, regarding practices and procedures in other states relative to the prevention and treatment of nonmelanoma skin cancer. (4) Public and private initiatives, programs, and efforts, if any, to raise awareness, encourage prevention, and provide treatment related to nonmelanoma skin cancer. (5) Legislation or regulatory policy, if any, to improve awareness, detection, and access to treatment options related to nonmelanoma skin cancer. (6) Economic analysis related to prevention, detection, and treatment of nonmelanoma skin cancer for Louisiana residents. (7) Public health impact analysis of nonmelanoma skin cancer as it pertains to age, gender, ethnicity, race, and socioeconomic status and the disparity, if any, of access and efficacy of prevention, detection, and treatment options within such demographic subgroups. BE IT FURTHER RESOLVED that the subcommittee shall make a report of findings and recommendations to the Legislature of Louisiana by December 1, 2024.
