ENROLLED 2023 Regular Session HOUSE RESOLUTION NO. 152 BY REPRESENTATIVE DESHOTEL A RESOLUTION To direct the Louisiana Department of Health to amend its administrative rule, LAC 48:I.12526(B), regarding the geographic location of a hospice provider within a fifty-mile radius of the hospice proposed geographic location. WHEREAS, LAC 48:I.12526(A) establishes that a hospice provider is eligible to be licensed by the Louisiana Department of Health upon meeting all of the requirements for licensure; and WHEREAS, LAC 48:I.12526(B) provides that the service area for a proposed or existing hospice provider is within a fifty-mile radius of the proposed geographic location where the provider is or will be licensed; and WHEREAS, the fifty-mile radius of the proposed geographic location places an undue burden on hospice providers who would serve patients where part of the parish is within the fifty-mile radius of the proposed geographic location, but the hospice provider is not able to service the entire parish; and WHEREAS, the fifty-mile radius of the proposed geographic location also places an undue burden on rural areas where a fifty-mile radius may be difficult to define. THEREFORE, BE IT RESOLVED that the House of Representatives of the Legislature of Louisiana does hereby direct the Louisiana Department of Health to amend its administrative rule regarding the geographic location of a hospice provider to authorize such providers to serve patients in any parish within a fifty-mile radius of their location.
