Requests the enforcement of certain littering ordinances in the city of New Orleans. 1 A RESOLUTION 2 To urge and request the city of New Orleans to enforce ordinances that prohibit littering on 3 or near the premises of commercial retail establishments and to take all necessary 4 steps to collect payment from the owners of properties that house such 5 establishments and the lessees of such owners for fines imposed for violations of 6 these ordinances, including the suspension, revocation, or nonrenewal of all 7 occupational licenses and other permits granted to the owners and lessees for the 8 legal operation of a commercial retail establishment. 9 WHEREAS, the city of New Orleans is a vibrant and lively city and a major driver 10 of the state's economy as it is an annual destination for millions of conventioneers and 11 tourists from all over the world; and 12 WHEREAS, it is imperative that the city recognize that effective litter control and 13 enforcement protects the health, safety, and welfare of its residents and enhances the beauty 14 and quality of the environment; and 15 WHEREAS, the city's residents, civic leaders, and business owners have a mutual 16 interest in maintaining all property located in the city in a safe and sanitary condition; and 17 WHEREAS, over the years, the New Orleans City Council has adopted many 18 ordinances that prohibit littering within the city and many residents, business owners, and Page 1 of 2 SR NO. 146 SLS 23RS-2289 ORIGINAL 1 tourists have received fines for violations of these ordinances; and 2 WHEREAS, recently, the amount of litter found on or near the premises of 3 commercial retail establishments has increased significantly and the owners of properties 4 that house these establishments and the lessees of such owners have repeatedly been found 5 in violation of the city's litter ordinances; and 6 WHEREAS, many of the owners and lessees have refused to pay the fines imposed 7 and the city has not been vigilant in collecting these fines and has continued to grant 8 occupational licenses and other business permits to these owners and lessees; and 9 WHEREAS, the city must take immediate action to curb littering on or near the 10 premises of commercial retail establishments as this matter is generating enormous concern 11 within the community and has risen to the level of a public nuisance by interfering with the 12 comfort and convenience of the general public. 13 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana 14 does hereby urge and request the city of New Orleans to enforce ordinances that prohibit 15 littering on or near the premises of commercial retail establishments and to take all necessary 16 steps to collect payment from the owners of properties that house such establishments and 17 the lessees of such owners for fines imposed for violations of these ordinances, including the 18 suspension, revocation, or nonrenewal of all occupational licenses and other permits granted 19 to the owners and lessees for the legal operation of a commercial retail establishment. 20 BE IT FURTHER RESOLVED that copy of this Resolution be transmitted to the 21 president of the New Orleans City Council.
