2023 Regular Session ENROLLED SENATE RESOLUTION NO. 179 BY SENATOR CLOUD A RESOLUTION To create and provide for the Task Force on Local Impacts of Carbon Capture and Sequestration. WHEREAS, Louisiana is a national leader on the cutting edge of industrial innovation in the oil and gas, petrochemical, and energy production industries; and WHEREAS, there is renewed worldwide interest in carbon capture and sequestration (CCS) projects as a means to reduce global greenhouse gas emissions; and WHEREAS, Louisiana is blessed with a world-class volume of available pore space for storage and is home to established pipeline, industry, transportation, and other key infrastructure, all in a compact geographical area, ideally positioning the state for development of the CCS sector into the future; and WHEREAS, in addition to helping improve the state's environment, CCS projects hold massive potential for economic growth, including job creation, increased energy production, and generation of business and tax revenue; and WHEREAS, Louisiana has submitted an Underground Injection Control program revision package to the U.S. Environmental Protection Agency, seeking approval of revisions to the state's Safe Drinking Water Act program to include Class VI injection well primary enforcement responsibility; and WHEREAS, primary enforcement responsibility, or primacy, for injection wells will allow the state to permit and oversee CCS projects with improved efficiency, giving Louisiana the edge in becoming a hub of sustainable growth and development of CCS industry innovation; and WHEREAS, with the rapid rise in research, development, and capitalization of CCS projects, it is vital that all stakeholders have a seat at the table to ensure that the rights and interests of all Louisianians are protected. THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana does hereby establish and provide for the Task Force on Local Impacts of Carbon Capture Page 1 of 3 SR NO. 179 ENROLLED and Sequestration to study and propose recommendations regarding the impact of carbon capture and sequestration projects across the state. BE IT FURTHER RESOLVED that the task force shall be comprised of the following members: (1) One member appointed by the president of the Senate. (2) Two members appointed by the chair of the Senate Committee on Natural Resources. (3) One member appointed by the chair of the Senate Committee on Finance. (4) One member appointed by the chair of the Senate Committee on Revenue and Fiscal Affairs. (5) The attorney general, or his designee. (6) The director of the Louisiana Mineral Law Institute, or his designee. BE IT FURTHER RESOLVED that the member appointed by the president of the Senate shall call the first meeting, which shall occur no later than August 15, 2023, and shall preside as chair until the task force elects a chair. BE IT FURTHER RESOLVED that the task force shall elect a chairman and other officers as the members may deem appropriate and shall follow applicable rules for committee procedure found in the Louisiana Senate Rules of Order. BE IT FURTHER RESOLVED that a majority of the task force membership shall constitute a quorum for the transaction of business, and any official action by the task force shall require an affirmative vote of a majority of the quorum present and voting. BE IT FURTHER RESOLVED that the task force shall meet as often as necessary, and in conducting its study, shall seek input and advice from all interested parties, which shall include the following: (1) State and local government entities. (2) Landowners. (3) Citizens. (4) Academic and research institutions. (5) Industry. (6) Utilities. Page 2 of 3 SR NO. 179 ENROLLED BE IT FURTHER RESOLVED that the members of the task force shall serve without compensation, except per diem or expenses reimbursement to which they may be individually entitled as members of their constituent organizations. BE IT FURTHER RESOLVED that the task force shall submit a final report on or before February 15, 2024, to the Senate Committee on Natural Resources, and upon submission of the final report, shall cease to exist. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the attorney general and the director of the Louisiana Mineral Law Institute. PRESIDENT OF THE SENATE Page 3 of 3
