ENROLLED ACT No. 495 2024 Regular Session HOUSE BILL NO. 268 BY REPRESENTATIVE MIKE JOHNSON 1 AN ACT 2 To amend and reenact R.S. 44:5(B)(4) and 11, relative to the confidentiality of certain 3 records; to provide for the confidential nature of certain personal information in a 4 personnel record; to remove certain exceptions relative thereto; to provide for the 5 confidentiality of certain records containing security details pertaining to schedule 6 of the governor or his spouse or child; and to provide for related matters. 7 Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 44:5(B)(4) and 11 are hereby amended and reenacted to read as 9 follows: 10 §5. Records of the office of the governor 11 * * * 12 B. 13 * * * 14 (4) Notwithstanding Paragraphs (1) and (2) of this Subsection, any record of 15 the office of the governor pertaining to the schedule of the governor, his spouse, or 16 his child that contains security details that if made public may impair the safety of 17 the governor, his spouse, or his child may be held confidential for a period not to 18 exceed seven days following the scheduled event. However, nothing in this 19 Paragraph shall be interpreted or construed in a manner to make confidential all 20 records concerning a meeting or event that the governor attends and transportation 21 related thereto. The governor may keep a record concerning a meeting or event that 22 the governor attends and transportation thereto privileged for a period not to exceed 23 seven days after the occurrence of the meeting or event. 24 * * * Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 268 ENROLLED 1 §11. Confidential nature of certain personnel records; exceptions 2 A. Notwithstanding anything contained in this Chapter or any other law to 3 the contrary, the following items in the personnel records of a public employee of 4 any public body shall be confidential: 5 (1) The home telephone number of the public employee where such 6 employee has chosen to have a private or unlisted home telephone number because 7 of the nature of his occupation with such body. 8 (2) The home and personal wireless telephone number of the public 9 employee where such employee has requested that the number be confidential. 10 (3)(2) The home address of the public employee where such employee has 11 requested that the address be confidential. 12 (3) The personal email address of the public employee. 13 (4) The name and account number of any financial institution to which the 14 public employee's wages or salary are directly deposited by an electronic direct 15 deposit payroll system or other direct deposit payroll system. 16 B. The provisions of R.S. 44:11(A)(3) shall not apply to the personnel 17 records of a city or parish school board to the extent that the home address of any 18 employee of a city or parish school board shall be made available to recognized 19 educational groups. 20 C. Notwithstanding any other provision of this Chapter, the social security 21 number and financial institution direct deposit information as contained in the 22 personnel records of a public employee of any public body shall be confidential. 23 However, when the employee's social security number or financial institution direct 24 deposit information is required to be disclosed pursuant to any other provision of 25 law, including such purposes as child support enforcement, health insurance, and 26 retirement reporting, the social security number or financial institution direct deposit 27 information of the employee shall be disclosed pursuant to such provision of law. 28 D. C. Notwithstanding anything contained in this Chapter or any other law 29 to the contrary, all medical records, claim forms, insurance applications, requests for 30 the payment of benefits, and all other health records of public employees, public Page 2 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 268 ENROLLED 1 officials, and their dependents in the personnel records of any public body shall be 2 confidential. However, nothing in this Chapter shall be intended to limit access to 3 employee records under the Code of Civil Procedure or Code of Evidence. 4 E. The provisions of Paragraph (A)(3) of this Section shall not apply to the 5 home address of a member of the Firefighters' Retirement System if that information 6 is requested by a member of the Louisiana Legislature, an agency or employer 7 reporting information to the system, or a recognized association of system members. 8 Section 2. This Act shall become effective upon signature by the governor or, if not 9 signed by the governor, upon expiration of the time for bills to become law without signature 10 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 11 vetoed by the governor and subsequently approved by the legislature, this Act shall become 12 effective on the day following such approval.
