HLS 24RS-61 ENGROSSED 2024 Regular Session HOUSE BILL NO. 312 BY REPRESENTATIVES OWEN, EDMONSTON, AND AMEDEE DRUGS: Provides relative to the over-the-counter sale and purchase of the drug ivermectin without a prescription 1 AN ACT 2To enact Part XI of Chapter 4 of Title 40 of the Louisiana Revised Statutes of 1950, to be 3 comprised of R.S. 40:1051 through 1053, relative to the over-the-counter sale and 4 purchase of the drug ivermectin; to provide for the sale and purchase of ivermectin 5 without a prescription; to provide for definitions; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. Part XI of Chapter 4 of Title 40 of the Louisiana Revised Statutes of 1950, 8comprised of R.S. 40:1051 through 1053, is hereby enacted to read as follows: 9 PART XI. IVERMECTIN ACCESS LAW 10 §1051. Short title 11 This Part shall be known and may be cited as the "Ivermectin Access Law". 12 §1052. Definitions 13 As used in this Part, the following terms have the following meanings: 14 (1) "Healthcare professional" is any person who is licensed in accordance 15 with the provisions of R.S. 37:1751. 16 (2) "Ivermectin" is a Food and Drug Administration-approved antiparasitic 17 drug used to treat several untreated tropical diseases and infections caused by some 18 parasitic worms and head lice and skin conditions like rosacea. 19 (3) "Over-the-counter medication" means medication that may be legally 20 sold and purchased without a prescription. Notwithstanding any other law to the contrary, ivermectin suitable for 3 human use may be sold or purchased as an over-the-counter medication in this state. 4 B. The sale or purchase as provided for in Subsection A of this Section shall 5 not require a prescription from any healthcare professional. Proposed law further provides that such sale or purchase shall not require a prescription from any healthcare professional.
