HOUSE BILL NO. 354
BY REPRESENTATIVE BRASS
1	AN ACT
2 To amend and reenact the heading of Chapter 7 of Title 48 of the Louisiana Revised Statutes
3 of 1950 and R.S. 48:1306, 1307, and 1308, relative to road lighting districts; to
4 authorize such districts to use funds for safety equipment; to provide relative to the
5 designations assigned to such districts; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  The heading of Chapter 7 of Title 48 of the Louisiana Revised Statutes
8 of 1950 and R.S. 48:1306, 1307, and 1308 are hereby amended and reenacted to read as
9 follows:
10	CHAPTER 7.  ROAD LIGHTING DISTRICTS AND
11	SECURITY AND ROAD LIGHTING DISTRICTS

13 §1306.  Power of parish governing authorities to create road lighting districts 
14	A.  Parish governing authorities may create road lighting districts, composed
15 of territory wholly within a parish.  A district so created shall be a political and legal
16 subdivision of the state, with full power to sue and be sued in its corporate name.  It
17 may enter into contracts with any electric public utility to provide and maintain
18 electric lights on the streets, roads, highways, alleys, and public places of the district. 
19	B.  A parish governing authority may also authorize any such district it
20 creates or any consolidated district it creates pursuant to R.S. 48:1301 to use up to
21 twenty-five percent of its funds to purchase, install, operate, and maintain electronic
22 safety equipment.

1 §1307.  Road lighting districts; security and road lighting districts; designation 
2	A.  Each such district shall be designated Road Lighting District No. ______
3 of the parish of ______.  The parish governing authority creating such district shall
4 be the governing authority thereof, and the parish treasurer shall be the treasurer of
5 the district.
6	B.(1)  A parish governing authority may designate a district that is authorized
7 to use funds in accordance with R.S. 48:1306(B) as a security and road lighting
8 district in a form similar to that provided by Subsection A of this Section for road
9 lighting districts.
10	(2)  Unless context indicates otherwise, references to road lighting districts
11 in this Chapter include any district designated by a parish governing authority as a
12 security and road lighting district.
13 §1308.  Road lighting districts; tax levy 
14	For the purpose of providing and maintaining such electric light on the
15 streets, roads, highways, alleys, and public places in such district purposes set forth
16 in R.S. 48:1306, any road lighting district may levy taxes not to exceed in any year
17 five mills on the dollar on all of the taxable property within the boundaries thereof,
18 except railroad rights of way and tracks located thereon.  However, the special tax
19 herein authorized by this Section shall not run for a longer period than ten years, and
20 the rate, purpose, and duration of any special tax first shall be submitted to the
21 electors of the district in which the tax is to be levied at an election called and held
22 for that purpose in the same manner as provided by law for elections for levying
23 taxes for the purposes set out in Section 32 of Article VI of the constitution
24 Constitution of Louisiana, and a majority of those voting shall have voted in favor
25 thereof.  
26 Section 2.(A)  The Louisiana State Law Institute is hereby authorized and directed
27 to renumber the Sections of Chapter 7 of Title 48 of the Louisiana Revised Statutes of 1950
28 as follows:  
29 (1)  Sections 1306, 1307, and 1308 shall be renumbered as 1301, 1302, and 1303
30 respectively.

1 (2)  Sections 1308.1, 1308.2, 1308.3, and 1308.4 shall be renumbered as 1303.1,
2 1303.2, 1303.3, and 1303.4 respectively.
3 (3)  Sections 1301, 1302, 1303, 1304, and 1305 shall be renumbered as 1304, 1305,
4 1306, 1307, and 1308 respectively.
5 (B)  The Louisiana State Law Institute is hereby authorized and directed to correct
6 statutory references within Chapter 7 of Title 48 of the Louisiana Revised Statutes of 1950
7 including such references in statutory provisions reenacted by this Act.
