COURTS: Provides relative to justice of the peace courts and constables in Avoyelles
1 AN ACT
2To amend and reenact R.S. 13:2586(C)(5) and (6)(b), relative to justice of the peace courts
3 in Avoyelles Parish; to provide relative to jurisdiction and procedures; to provide for
4 jurisdiction over property standards and nuisance violations; to provide relative to
5 summons and subpoenas by constables; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 13:2586(C)(5) and (6)(b) are hereby amended and reenacted to read
8as follows:
9 ยง2586. Jurisdiction and procedure

11 (5) A justice of the peace court in Caddo Parish and Avoyelles Parish shall
12 have concurrent jurisdiction over property standards violations within its territorial
13 jurisdiction their respective jurisdictions, pursuant to local ordinance. In addition,
14 a constable of a justice of the peace court in Caddo Parish and Avoyelles Parish may
15 issue summons and serve subpoenas for such violations occurring anywhere within
16 the territorial jurisdiction of the respective justice of the peace court.

19 (b) A justice of the peace court in St. Tammany Parish and Avoyelles Parish
20 shall have concurrent jurisdiction over a property standards or nuisance violation

1 adopted pursuant to local ordinance, except as provided in Subparagraph (c) of this
2 Paragraph.

Abstract: Provides for the jurisdiction of justice of the peace courts in Avoyelles Parish.
Present law provides that the justice of the peace courts in Caddo Parish shall have
concurrent jurisdiction with district courts over property standards violations in the district.
Present law provides that a constable of a justice of a peace court in Caddo Parish may issue
summons and serve subpoenas for violations that occur in the district.
Proposed law retains present law and adds the constables and justice of the peace courts in
Avoyelles Parish.
Present law provides that the justice of the peace courts in St. Tammany Parish shall have
concurrent jurisdiction with district courts over property standards and nuisance violations,
with the exclusion of certain wards.
Proposed law adds that the justice of the peace courts in Avoyelles Parish shall have
concurrent jurisdiction with district courts over property standards and nuisance violations.
