HLS 24RS-774 ENGROSSED 2024 Regular Session HOUSE BILL NO. 442 BY REPRESENTATIVES ROBBY CARTER, MUSCARELLO, AND WILEY JUDGES: Creates an additional judgeship for the 21 st Judicial District Court 1 AN ACT 2To amend and reenact R.S. 13:477(21) and 621.21(A) and (E), relative to the Twenty-First 3 Judicial District Court; to create an additional judgeship for the Twenty-First Judicial 4 District Court; to provide for the election and term of the additional judge; to provide 5 for election sections from which judges are elected; to provide for effectiveness; and 6 to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 13:477(21) and 621.21(A) and (E) are hereby amended and reenacted 9to read as follows: 10 §477. Judicial districts 11 There shall be forty-one judicial districts in the state and each district shall 12 be composed as follows: 13 * * * 14 (21) The parishes of Tangipahoa, Livingston, and St. Helena shall compose 15 the Twenty-First District. The Twenty-First District consists of two election 16 sections. Election Section 1 is composed of Livingston Parish and Precincts 28, 33, 17 40A, 41, 42, 44, 45A, 45B, 70, 70A, 71, 72, 72A, 73, 74, 106A, 108, 110, 112, 114, 18 116, 117, 118, 118A, 120, 120A, 120B, 121, 121A, 122A, 122B, 122C, 124, 125, 19 127, 133, 133A, 137, 137A, 137B, 137C, 137D, 139, 141, 141A, 143, 143A, 145, 20 147, 149, 149A, and 151 of Tangipahoa Parish. Twenty-First Judicial District 5 A. The Twenty-First Judicial District Court shall have nine ten judges. 6 * * * 7 E.(1) The Except as provided by Paragraph (2) of this Subsection, the judges 8 and their successors created by this Section shall be elected at large and shall have 9 jurisdiction throughout the district. The judges shall be elected for a six-year term 10 at the congressional election held in 2014 and every sixth year thereafter. 11 (2)(a) The additional judge added to the court in 2024 shall be elected from 12 election section two as provided by R.S. 13:477(21). 13 (b) The individual to be elected to the additional judgeship shall be elected 14 as provided by Article V, Section 22 of the Constitution of Louisiana and shall serve 15 a term which begins on January 1, 2025, and which shall expire at the same time as 16 is provided by law for the other judges of the court. Thereafter, the successors to the 17 judge provided for in this Paragraph shall be elected at the same time and in the same 18 manner and shall serve the same term as is provided by law for other judges of the 19 court. 20 * * * 21 Section 2. This Act shall become effective upon signature by the governor or, if not 22signed by the governor, upon expiration of the time for bills to become law without signature 23by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 24vetoed by the governor and subsequently approved by the legislature, this Act shall become 25effective on the day following such approval. Present law provides that the 21st Judicial District Court is comprised of Livingston, St. Helena, and Tangipahoa Parishes. Provides that the 21st Judicial District Court has nine judges, who are elected at large. Proposed law adds a 10th judge to the 21st Judicial District Court. Proposed law divides the 21st Judicial District Court into two election sections and provides that nine judges are assigned to election section one and one judge is assigned to election section two. Provides that the additional judge added by proposed law shall be elected from election section two and that his initial term begins on Jan. 1, 2025. Effective upon signature of governor or lapse of time for gubernatorial action.
