ENROLLED ACT No. 251 2024 Regular Session HOUSE BILL NO. 515 BY REPRESENTATIVES HORTON, AMEDEE, BAYHAM, BERAULT, BILLINGS, BUTLER, CARLSON, COX, ECHOLS, EDMONSTON, EMERSON, FIRMENT, GLORIOSO, OWEN, SCHAMERHORN, TARVER, AND W ILDER 1 AN ACT 2 To enact R.S. 39:364.1, relative to combustion engine vehicles; to provide for freedom of 3 choice for private individuals in the selection of vehicles; to specify that air quality 4 challenges cannot restrict a citizen's ability to purchase a vehicle; and to provide for 5 related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 39:364.1 is hereby enacted to read as follows: 8 ยง364.1. Preservation of choice in vehicle purchases; combustion engine vehicles 9 A. For purposes of this Section, "combustion engine vehicle" shall mean the 10 component of a motor vehicle that converts the chemical energy in fuel into 11 mechanical energy for power. 12 B. No state agency shall restrict the use or sale of a motor vehicle by any 13 citizen based on the energy source used to power the motor vehicle, including the 14 energy source used for propulsion or use of powering other functions of the motor 15 vehicle. No state agency shall limit or prohibit the use or sale of a new motor 2 vehicle with an internal combustion engine. Further, any air quality challenges in 3 R.S. 30:2060(L), relative to "Louisiana's Toxic Air Pollutant Emission Control 4 Program" shall not restrict the ability of Louisiana citizens to purchase any vehicle.
