MOTOR VEHICLES: Provides relative to zero emission vehicles
1 AN ACT
2To enact R.S. 32:1252(76) and 1261(C), relative to zero emission vehicles; to provide a
3 definition for zero emission vehicles; to provide for unauthorized acts and exceptions
4 for direct sales; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 32:1252(76) and 1261(C) are hereby enacted to read as follows:
7 §1252. Definitions
8 The following words, terms, and phrases, when used in this Chapter, shall
9 have the meanings respectively ascribed to them in this Section, except where the
10 context clearly indicates a different meaning:

12 (76) "Zero emission vehicle" means a vehicle that emits no exhaust gas from
13 the onboard source of power, other than water vapor.

17 C. The provisions of this Section shall not apply to a manufacturer that has
18 not previously offered a franchise to an independent dealer in the state and produces
19 only zero emission vehicles to own, operate, or control a new motor vehicle
20 dealership that sells new vehicles that are only of that manufacturer's makes or lines,

1 or to own, operate, control, or contract with companies that provide finance, leasing,
2 or service for vehicles that are of that manufacturer's makes or lines.

Abstract: Defines "zero emission vehicles" and provides an exception from unauthorized
acts for the direct sale of zero emission vehicles by certain manufacturers.
Proposed law defines "zero emission vehicles" as a vehicle that emits no exhaust gas from
the onboard source of power, other than the water vapor.
Proposed law specifies unauthorized acts to include an exception for the direct sale of zero
emission vehicles manufacturers in present law. Specifies that present law does not apply
to a manufacturer that has not previously offered a franchise to an independent dealer in the
state and produces only zero emission vehicles to own, operate, or control a new motor
vehicle dealership that sells new vehicles that are only of that manufacturers makes or lines,
or to own, operate, control, or contract with companies that provide financing, leasing, or
service for vehicles that are of that manufacturer's makes or lines.
