ENROLLED ACT No. 439 2024 Regular Session HOUSE BILL NO. 641 BY REPRESENTATIVES KNOX, BAYHAM, BOYD, BRAUD, BRYANT, CHASSION, COX, DEWITT, GREEN, JACKSON, LAFLEUR, LYONS, MUSCARELLO, NEWELL, SELDERS, THOMPSON, WALTERS, OWEN, ROMERO, TAYLOR, AND BUTLER 1 AN ACT 2 To enact R.S. 47:463.230 through 463.236, relative to motor vehicle special prestige license 3 plates; to provide for the establishment of the "3' for Cyclists", "Support Wildlife 4 Rehabilitation", "St. Thomas Aquinas", "Evangel Christian Academy", "United 5 States Submarine Veterans", "Leesville High School Alumni", and "Humane Society 6 of Louisiana" specialty license plates; to provide for the creation, issuance, design, 7 fees, implementation, distribution, and rule promulgation applicable to such license 8 plates; and to provide for related matters. 9 Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 47:463.230 through 463.236 are hereby enacted to read as follows: 11 §463.230. Special prestige license plate; "3' for Cyclists" 12 A. The secretary of the Department of Public Safety and Corrections shall 13 establish a special prestige motor vehicle license plate to be known as the "3' for 14 Cyclists" plate, provided that there is a minimum of one thousand applicants for such 15 plate. The plate shall be restricted to use on passenger cars, pickup trucks, 16 recreational vehicles, motorcycles, and vans. 17 B. The secretary shall work in conjunction with the Metro Bicycle Coalition 18 of New Orleans, otherwise known as Bike Easy, to select the color and design of the 19 plate, provided it is in compliance with R.S. 47:463(A)(3). The special prestige license plate shall be issued, upon application, to any 2 citizen of Louisiana in the same manner as any other motor vehicle license plate. 3 D. The department shall collect an annual royalty fee of twenty-five dollars 4 that shall be disbursed in accordance with Subsection E of this Section. This royalty 5 fee shall be in addition to the standard motor vehicle license tax imposed by Article 6 VII, Section 5 of the Constitution of Louisiana, and a handling fee of three dollars 7 and fifty cents for each plate to be retained by the department to offset a portion of 8 administrative costs. 9 E. The annual royalty fee shall be collected by the department and forwarded 10 to the Metro Bicycle Coalition of New Orleans. The monies received from the 11 royalty fees shall be used to assist the Metro Bicycle Coalition of New Orleans. 12 F. The secretary shall promulgate and adopt rules and regulations as are 13 necessary to implement the provisions of this Section. 14 §463.231. Special prestige license plate; "Support Wildlife Rehabilitation" 15 A. The secretary of the Department of Public Safety and Corrections shall 16 establish a special prestige motor vehicle license plate to be known as the "Support 17 Wildlife Rehabilitation" plate, provided that there is a minimum of one thousand 18 applicants for such plate. The plate shall be restricted to use on passenger cars, 19 pickup trucks, recreational vehicles, motorcycles, and vans. 20 B. The secretary shall work in conjunction with the NOLA Wildlife Center 21 to select the color and design of the plate, provided it is in compliance with R.S. 22 47:463(A)(3). The design shall include the words "Support Wildlife 23 Rehabilitation"and an image or logo of a wild animal. 24 C. The special prestige license plate shall be issued, upon application, to any 25 citizen of Louisiana in the same manner as any other motor vehicle license plate. 26 D. The department shall collect an annual royalty fee of twenty-five dollars 27 that shall be disbursed in accordance with Subsection E of this Section. The annual royalty fee shall be collected by the department and forwarded 4 to the NOLA Wildlife Center. The monies received from the royalty fees shall be 5 used to assist with the costs of wildlife rehabilitation and may be distributed by the 6 NOLA Wildlife Center in the form of grants to licensed wildlife rehabilitators or 7 licensed wildlife rehabilitation centers. 8 F. The secretary shall promulgate and adopt rules and regulations as are 9 necessary to implement the provisions of this Section. 10 §463.232. Special prestige license plate; "St. Thomas Aquinas" 11 A. The secretary of the Department of Public Safety and Corrections shall 12 establish a special prestige motor vehicle license plate to be known as the "St. 13 Thomas Aquinas" plate provided that there is a minimum of one hundred applicants 14 for such plate. The plate shall be restricted to use on passenger cars, pickup trucks, 15 recreational vehicles, motorcycles, and vans. 16 B. The secretary shall work in conjunction with the St. Thomas Aquinas 17 Regional Catholic High School, to select the color and design of the plate, provided 18 it is in compliance with R.S. 47:463(A)(3). The design shall include the words "St. 19 Thomas Aquinas". 20 C. The special prestige license plate shall be issued, upon application, to any 21 citizen of Louisiana in the same manner as any other motor vehicle license plate. 22 D. The department shall collect an annual royalty fee of twenty-five dollars 23 that shall be disbursed in accordance with Subsection E of this Section. This royalty 24 fee shall be in addition to the standard motor vehicle license tax imposed by Article 25 VII, Section 5 of the Constitution of Louisiana, and a handling fee of three dollars 26 and fifty cents for each plate to be retained by the department to offset a portion of 27 administrative costs. 28 E. The annual royalty fee shall be collected by the department and forwarded 29 to the St. Thomas Aquinas Regional Catholic High School. The monies received 30 from the royalty fees shall be used to assist the administration of the school. Special prestige license plate; "Evangel Christian Academy" 4 A. The secretary of the Department of Public Safety and Corrections shall 5 establish a special prestige motor vehicle license plate to be known as the "Evangel 6 Christian Academy" plate, provided that there is a minimum of one hundred 7 applicants for such plate. The plate shall be restricted to use on passenger cars, 8 pickup trucks, recreational vehicles, motorcycles, and vans. 9 B. The secretary shall work in conjunction with Evangel Christian Academy 10 administration, to select the color and design of the plate, provided it is in 11 compliance with R.S. 47:463(A)(3). The design shall include the words "Evangel 12 Christian Academy". 13 C. The special prestige license plate shall be issued, upon application, to any 14 citizen of Louisiana in the same manner as any other motor vehicle license plate. 15 D. The department shall collect an annual royalty fee of twenty-five dollars 16 that shall be disbursed in accordance with Subsection E of this Section. This royalty 17 fee shall be in addition to the standard motor vehicle license tax imposed by Article 18 VII, Section 5 of the Constitution of Louisiana, and a handling fee of three dollars 19 and fifty cents for each plate to be retained by the department to offset a portion of 20 administrative costs. 21 E. The annual royalty fee shall be collected by the department and forwarded 22 to the Evangel Christian Academy's administration. The monies received from the 23 royalty fees shall be used to assist the school. 24 F. The secretary shall promulgate and adopt rules and regulations as are 25 necessary to implement the provisions of this Section. 26 §463.234. Special prestige license plate; "United States Submarine Veterans" 27 A. The secretary of the Department of Public Safety and Corrections shall 28 establish a special prestige motor vehicle license plate to be known as the "United 29 States Submarine Veterans" plate, provided that there is a minimum of one thousand Page 4 of 7 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 641 ENROLLED 1 applicants for such plate. The plate shall be restricted to use on passenger cars, 2 pickup trucks, recreational vehicles, motorcycles, and vans. 3 B. The secretary shall work in conjunction with the United States Submarine 4 Veterans Charitable Foundation, Inc., to select the color and design of the plate, 5 provided it is in compliance with R.S. 47:463(A)(3). The design shall include the 6 words "United States Submarine Veterans". 7 C. The special prestige license plate shall be issued, upon application, to any 8 citizen of Louisiana in the same manner as any other motor vehicle license plate. 9 D. The department shall collect an annual royalty fee of twenty-five dollars 10 that shall be disbursed in accordance with Subsection E of this Section. This royalty 11 fee shall be in addition to the standard motor vehicle license tax imposed by Article 12 VII, Section 5 of the Constitution of Louisiana, and a handling fee of three dollars 13 and fifty cents for each plate to be retained by the department to offset a portion of 14 administrative costs. 15 E. The annual royalty fee shall be collected by the department and forwarded 16 to the treasurer of the United States Submarine Veterans Charitable Foundation, Inc. 17 The monies received from the royalty fees shall be used to provide scholarships for 18 children. 19 F. The secretary shall promulgate and adopt rules and regulations as are 20 necessary to implement the provisions of this Section. 21 §463.235. Special prestige license plate; "Leesville High School Alumni" 22 A. The secretary of the Department of Public Safety and Corrections shall 23 establish a special prestige motor vehicle license plate to be the "Leesville High 24 School Alumni " plate, provided that there is a minimum of one thousand applicants 25 for such plate. The plate shall be restricted to use on passenger cars, pickup trucks, 26 recreational vehicles, motorcycles, and vans. 27 B. The secretary shall work in conjunction with the Alumni Association 28 Executive Board, to select the color and design of the plate, provided it is in 29 compliance with R.S. 47:463(A)(3). The secretary shall promulgate and adopt rules and regulations as are 13 necessary to implement the provisions of this Section. 14 §463.236. Special prestige license plate; "Humane Society of Louisiana" 15 A. The secretary of the Department of Public Safety and Corrections shall 16 establish a special prestige motor vehicle license plate to be the "Humane Society of 17 Louisiana" plate, provided that there is a minimum of one thousand applicants for 18 such plate. The plate shall be restricted to use on passenger cars, pickup trucks, 19 recreational vehicles, motorcycles, and vans. 20 B. The secretary shall work in conjunction with the Humane Society of 21 Louisiana, to select the color and design of the plate, provided it is in compliance 22 with R.S. 47:463(A)(3). The design shall include the words "Humane Society of 23 Louisiana". 24 C. The special prestige license plate shall be issued, upon application, to any 25 citizen of Louisiana in the same manner as any other motor vehicle license plate. 26 D. The department shall collect an annual royalty fee of twenty-five dollars 27 that shall be disbursed in accordance with Subsection E of this Section. The annual royalty fee shall be collected by the department and forwarded 4 to the treasurer of the Humane Society of Louisiana. The monies received from the 5 royalty fees shall be used to fund spay and neuter programs to help with current 6 overpopulation of animals. 7 F. The secretary shall promulgate and adopt rules and regulations as are 8 necessary to implement the provisions of this Section. 9 Section 2. The Department of Public Safety and Corrections, office of motor 10 vehicles, is hereby directed to create these special prestige license plates when the applicable 11 statutory provisions are met and its system is updated to accommodate the creation of new 12 plates.
