HOUSE BILL NO. 695

1	AN ACT
2 To enact R.S. 32:387.21, 387.22, and 387.23, relative to trucks transporting materials; to
3 authorize the issuance of per project special permits for trucks transporting materials;
4 to establish a fee for the special permit; to provide for a weight limitation; to
5 establish certain requirements for permit holders; to provide for a penalty; to provide
6 for rule promulgation; and to provide for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 32:387.21, 387.22, and 387.23 are hereby enacted to read as follows: 
9 §387.21.  Special permit; trucks transporting earthen materials for government
10	funded levee projects
11	A.  Notwithstanding any other provision of law to the contrary, the secretary
12 shall issue a per project special overweight permit for each truck transporting earthen
13 materials for government funded levee projects.  Each per project permit shall be
14 valid for one year from the date of issuance.
15	B.  The permit shall be issued in accordance with the following provisions:
16	(1)  Upon application for a special permit, the applicant shall designate the
17 specific routes to be utilized for transporting the materials and identify the project
18 for which they are transporting materials.
19	(2)  The fee for the permit shall be one thousand dollars per project.
20 However, if the project exceeds the one-year validity of the permit, a new permit
21 shall be required.

1	(3)  The permit shall authorize the operation of the vehicle or straight truck
2 at a gross weight not to exceed seventy thousand pounds for which twenty-two
3 thousand pounds for steering axle and forty-eight thousand pounds for tridum group
4 while operating on any state-maintained highway except on the Interstate system. 
5 Nothing contained in this Section shall preempt municipal or parish ordinances from
6 regulating weight limits on municipal or parish streets or roads.
7	C.  The secretary shall impose a penalty for each violation of the weight limit
8 pursuant to R.S. 32:388.
9	D.  As used in this Section, "earthen materials" includes minerals, rocks, and
10 soil.
11	E.  The secretary may promulgate rules and regulations in accordance with
12 the Administrative Procedure Act as are necessary to enforce the provisions of this
13 Section.
14 §387.22.  Special permit; ten percent weight variance for trucks, trucks and trailers
15	hauling raw input materials for concrete and finished concrete products
16	Notwithstanding any provision of law to the contrary, relating only to the
17 hauling of raw input materials for concrete and finished concrete products, the
18 secretary shall issue annual special permits for a fee of four hundred dollars per unit
19 that prohibit both gross weight and axle weight penalties for the operation of trucks
20 or truck-and-trailers on roads of the state when the total excess weight is ten percent
21 or less of the truck or truck and trailer's maximum permissible gross weight as
22 provided by law. The permit shall not authorize any truck or truck-trailer
23 combination described in this Part to exceed load posted weight limits on any bridge.
24 §387.23.  Special permit; twelve percent weight variance for single unit dump
25	trucks.
26	Notwithstanding any provision of law to the contrary, relating only to single
27 unit dump-trucks and with no limitation as to the material being hauled, the secretary
28 shall issue annual special permits for a fee of eight hundred dollars per truck that
29 prohibit both gross weight and axle weight penalties for the operation of dump trucks
30 on state-maintained highways when the total excess weight is twelve percent or less

1 of the truck's maximum permissible gross weight as provided by law. The permit
2 shall not authorize any truck described in this Part to exceed load posted weight
3 limits on any bridge.
