HOUSE BILL NO. 884
BY REPRESENTATIVES HUGHES, ADAMS, FISHER, AND MARCELLE
1	AN ACT
2 To amend and reenact R.S. 39:1619(B)(introductory paragraph) and to enact R.S.
3 39:1619(E) and 1621(D), relative to procurement by public postsecondary education
4 management boards; to provide relative to procurement of consulting services and
5 social service contracts; to authorize master service agreements for such services in
6 certain circumstances; to provide for an effective date; and to provide for related
7 matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 39:1619(B)(introductory paragraph) is hereby amended and reenacted
10 and R.S. 39:1619(E) and 1621(D) are hereby enacted to read as follows: 
11 §1619.  Social service contracts

13	B.  Contracts Except as provided in Subsection E of this Section, contracts
14 for social services may be awarded without the necessity of competitive bidding or
15 competitive negotiation only if the state chief procurement officer determines that
16 any one of the following conditions is present.  The using agency shall document the
17 condition present and such documentation shall be part of the contract record
18 submitted to the office of state procurement.

1	E.(1)  Notwithstanding any provision of law to the contrary, each public
2 postsecondary education management board, including a board participating in the
3 higher education procurement code pursuant to R.S. 17:3139.5 or 3393, may enter
4 into social service contracts on behalf of each institution under its supervision and
5 control, including the authority to enter into a master service contract for social
6 services with a vendor for similar or the same services to be provided at multiple
7 institutions within its supervision and control.
8	(2)  A master service contract pursuant to the provisions of this Subsection
9 may contain a combined total compensation to the vendor with compensation for
10 each institution serviced by the contract.  Such contract may be entered into without
11 the necessity of competitive bidding or competitive negotiation if the compensation
12 for each institution serviced by the agreement does not exceed two hundred fifty
13 thousand dollars per twelve-month period.

15 §1621.  Consulting service contracts

17	D.(1)  Notwithstanding any provision of law to the contrary, each public
18 postsecondary education management board, including a board participating in the
19 higher education procurement code pursuant to R.S. 17:3139.5 or 3393, may enter
20 into consulting services contracts on behalf of each institution under its supervision
21 and control, including the authority to enter into a master service contract for
22 consulting services with a vendor for similar or the same services to be provided at
23 multiple institutions within its supervision and control.
24	(2)  A master service contract pursuant to the provisions of this Subsection
25 may contain a combined total compensation to the vendor with compensation for
26 each institution serviced by the agreement.  Such contract may be entered into
27 without the necessity of competitive bidding or competitive negotiation if the
28 compensation for each institution serviced by the contract does not exceed seventy-
29 five thousand dollars per twelve-month period.

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2 signed by the governor, upon expiration of the time for bills to become law without signature
3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
4 vetoed by the governor and subsequently approved by the legislature, this Act shall become
5 effective on the day following such approval.
