HLS 24RS-1617 ORIGINAL 2024 Regular Session HOUSE BILL NO. 934 BY REPRESENTATIVE LACOMBE ENERGY/CONSERVATI ON: Provides for the dedication of revenue from carbon dioxide sequestration on state lands and water bottoms 1 AN ACT 2To amend and reenact R.S. 30:149(B)(introductory paragraph) and (C) and 3 209.2(B)(introductory paragraph) and (C) and to enact R.S. 30:149(D), 157, and 4 209.2(D), relative to the dedication of revenue from carbon dioxide sequestration on 5 state lands; to provide for revenue from carbon dioxide sequestration on property 6 under the jurisdiction of the Department of Wildlife and Fisheries and the Wildlife 7 and Fisheries Commission; to dedicate revenue to local governing authorities; and 8 to provide for related matters. 9Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 30:149(B)(introductory paragraph) and (C) and 11209.2(B)(introductory paragraph) and (C) are hereby amended and reenacted and R.S. 1230:149(D), 157, and 209.2(D) are hereby enacted to read as follows: 13 §149. Storage of carbon dioxide; distribution of funds 14 * * * 15 B. Except as provided in Subsections C and D of this Section, any Any 16 revenues collected by the office of mineral resources pursuant to any contractual 17 agreement for the storage of carbon dioxide beneath state-owned land or water 18 bottoms shall be immediately forwarded to the state treasurer for deposit into the 19 state treasury. Except as provided in Subsection D of this Section, nothing Nothing in 5 this Section shall impact existing constitutional or statutory dedications from funds 6 collected by the office of mineral resources on behalf of a state department or an 7 agency as defined in R.S. 30:151. 8 D. Any revenues collected by the office of mineral resources pursuant to any 9 contractual agreement regarding the storage of carbon dioxide or pore space rights 10 beneath properties owned or managed by, or otherwise under the jurisdiction of, the 11 Department of Wildlife and Fisheries or the Wildlife and Fisheries Commission, 12 including but not limited to wildlife management areas and refuges, shall be 13 immediately forwarded to the state treasurer for deposit into the state treasury. After 14 complying with the provisions of Article VII, Section 9(B) of the Constitution of 15 Louisiana relative to the Bond Security and Redemption Fund, the state treasurer 16 shall remit the funds as follows: 17 (1) Fifteen percent of the revenue shall be remitted to the governing 18 authority of the parish located in a specific area of interest. If the specific area of 19 interest is located in more than one parish, the monies shall be divided between the 20 parishes in proportion to the amount of property located in each parish pursuant to 21 the contractual agreement. 22 (2) The remaining revenue shall be deposited into the Wildlife and Fisheries 23 Conservation Fund. 24 * * * 25 §157. Storage of carbon dioxide; distribution of funds 26 A. HLS 24RS-1617 ORIGINAL HB NO. 934 1 Commission for the purpose of injection, storage, sequestration, transportation, 2 shipment, or withdrawal of carbon dioxide. 3 B. Any revenues collected by the Department of Wildlife and Fisheries or 4 the Wildlife and Fisheries Commission pursuant to any contractual agreement 5 regarding the storage of carbon dioxide or pore space rights beneath properties 6 owned or managed by, or otherwise under the jurisdiction of, the Department of 7 Wildlife and Fisheries or the Wildlife and Fisheries Commission, including but not 8 limited to wildlife management areas and refuges, shall be immediately forwarded 9 to the state treasurer for deposit into the state treasury. After complying with the 10 provisions of Article VII, Section 9(B) of the Constitution of Louisiana relative to 11 the Bond Security and Redemption Fund, the state treasurer shall remit the funds as 12 follows: 13 (1) Fifteen percent of the revenue shall be remitted to the governing 14 authority of the parish located in a specific area of interest. HLS 24RS-1617 ORIGINAL HB NO. 934 (1)30% to the Mineral and Energy Operation Fund. (2)30% to parishes included in the agreement. If one or more parishes is included in the agreement, the 30% will be divided based on the amount of land in each parish included in the agreement. (3)The remaining funds are deposited into the state general fund. Proposed law provides an exception to the distribution of funds under present law for funds collected by the office of mineral resources for the storage of carbon dioxide beneath lands and water bottoms under the jurisdiction of the Dept. of Wildlife and Fisheries and the Wildlife and Fisheries Commission. Under proposed law, these funds will be distributed as follows: (1)15% to parishes included in the agreement. If one or more parishes is included in the agreement, the 15% will be divided based on the amount of land in each parish included in the agreement. (2)The remainder to the Conservation Fund. Present law further provides that this dedication of revenue does not affect existing constitutional or statutory dedications of funds collected by the office of mineral resources on behalf of a state agencies. Proposed law provides that the distribution of Wildlife and Fisheries' revenue under proposed law is an exception to present law. Proposed law further provides for the following distribution of funds collected by the Dept. of Wildlife and Fisheries or the Wildlife and Fisheries Commission if they lease their own lands for the storage of carbon dioxide on lands or water bottoms under their jurisdiction: (1)15% to parishes included in the agreement. If one or more parishes is included in the agreement, the 15% will be divided based on the amount of land in each parish included in the agreement. (2)The remainder to the Conservation Fund.
