ENROLLED 2024 Regular Session HOUSE BILL NO. 934 BY REPRESENTATIVES LACOMBE, BOYER, BRASS, BRAUD, BROWN, BRYANT, CARRIER, COATES, DEWITT, EDMONSTON, FONTENOT, JACKSON, TRAVIS JOHNSON, LAFLEUR, JACOB LANDRY, MACK, MARCELLE, ORGERON, OWEN, RISER, SCHAMERHORN, TAYL OR, AND THOMPSON 1 AN ACT 2 To amend and reenact R.S. 30:149(B)(introductory paragraph) and (C) and 3 209.2(B)(introductory paragraph) and (C) and R.S. 56:765 and to enact R.S. 4 30:149.1, relative to the dedication of revenue from carbon dioxide sequestration on 5 state lands; to provide for revenue from carbon dioxide sequestration on property 6 under the jurisdiction of the Department of Wildlife and Fisheries and the Louisiana 7 Wildlife and Fisheries Commission; to dedicate revenue to local governing 8 authorities; and to provide for related matters. 9 Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 30:149(B)(introductory paragraph) and (C) and 11 209.2(B)(introductory paragraph) and (C) are hereby amended and reenacted and R.S. 12 30:149.1 is hereby enacted to read as follows: 13 §149. Storage of carbon dioxide; distribution of funds 14 * * * 15 B. Except as provided in Subsection C of this Section, any Any revenues 16 collected by the office of mineral resources pursuant to any contractual agreement 17 for the storage of carbon dioxide beneath state-owned land or water bottoms shall be 18 immediately forwarded to the state treasurer for deposit into the state treasury. After 19 complying with the provisions of Article VII, Section 9(B) of the Constitution of 20 Louisiana relative to the Bond Security and Redemption Fund, the state treasurer 21 shall remit the funds as follows: 22 * * * 23 C. Any revenues collected by 2 the office of mineral resources pursuant to any contractual agreement regarding the 3 storage of carbon dioxide or pore space rights beneath properties owned or managed 4 by, or otherwise under the jurisdiction of, the Department of Wildlife and Fisheries 5 or the Louisiana Wildlife and Fisheries Commission, including but not limited to 6 wildlife management areas and refuges, shall be immediately forwarded to the state 7 treasurer for deposit into the state treasury. After complying with the provisions of 8 Article VII, Section 9(B) of the Constitution of Louisiana relative to the Bond 9 Security and Redemption Fund, the state treasurer shall remit the funds as follows: 10 (1) Thirty percent of the revenue shall be remitted to the governing authority 11 of the parish located in a specific area of interest. If the specific area of interest is 12 located in more than one parish, the monies shall be divided between the parishes in 13 proportion to the amount of property located in each parish pursuant to the 14 contractual agreement. 15 (2) The remaining revenue shall be deposited into the Louisiana Wildlife and 16 Fisheries Conservation Fund. 17 * * * 18 §149.1. Storage of carbon dioxide; Department of Wildlife and Fisheries or 19 Louisiana Wildlife and Fisheries Commission agreements; distribution of 20 funds 21 A. For purposes of this Section, "specific area of interest" means an 22 individual tract of property that is the subject of any contractual agreement entered 23 into by the Department of Wildlife and Fisheries or the Louisiana Wildlife and 24 Fisheries Commission for the purpose of injection, storage, sequestration, 25 transportation, shipment, or withdrawal of carbon dioxide. 26 B. Any revenues collected by the Department of Wildlife and Fisheries or 27 the Louisiana Wildlife and Fisheries Commission pursuant to any contractual 28 agreement regarding the storage of carbon dioxide or pore space rights beneath 29 properties owned or managed by, or otherwise under the jurisdiction of, the 30 Department of Wildlife and Fisheries or the Louisiana Wildlife and Fisheries 31 Commission, including but not limited to wildlife management areas and refuges, 32 shall be immediately forwarded to the state treasurer for deposit into the state Page 2 of 4 CODING: Words in struck through type are deletions from existing law; words underscored are additions. R.S. 56:765 is hereby amended and reenacted to read as follows: 9 §765. Donations for wildlife refuges, wildlife management areas, and public hunting 10 grounds; applicability of certain laws 11 The provisions of R.S. 30:148.1 - 148.7 and R.S. 47:648.1 dedication of 12 funds provided for in R.S. 30:149, 149.1, and 209.2 shall not authorize the breach of 13 any term or condition of any donation which has been accepted by the state involving 14 any state wildlife refuge, wildlife management area, or public hunting ground which 15 was accepted by the state prior to August 1, 2024. A parish governing authority may 16 tailor or restrict its use of any funds received pursuant to R.S. 30:149, 149.1, or 209.2 17 in order to comply with the terms or conditions of such donations.
