HLS 24RS-4389 ENGROSSED 2024 Regular Session HOUSE CONCURRENT RESOL UTION NO. 134 BY REPRESENTATIVE CREWS UTILITIES: Directs utility companies to help facilitate the reporting requirements of the HUD Green mortgage insurance premiums program 1 A CONCURRENT RESOL UTION 2To direct utility providers to help facilitate the reporting requirements of the HUD Green 3 mortgage insurance premiums program. 4 WHEREAS, the United States Department of Housing and Development, or HUD, 5requires annual reporting in order for building owners to utilize the Green mortgage 6insurance premiums, or MIP, program; and 7 WHEREAS, according to HUD, for borrowers utilizing federal housing 8administration-insured financing, the Green MIP program is an incentive intended to 9encourage multifamily property owners to adopt higher standards for construction, 10rehabilitation, repairs, maintenance, and property operations that are more energy efficient 11and sustainable than traditional approaches to such activities; and 12 WHEREAS, this state wants to ensure property developers are able to utilize the 13Green MIP program incentive; and 14 WHEREAS, this state has a dearth of affordable and market rate housing available; 15and 16 WHEREAS, HUD incentivizes developers to build these properties; and 17 WHEREAS, it has historically been burdensome upon property management teams 18to collect the energy consumption data of properties as required by HUD for the Green MIP 19program; and 20 WHEREAS, even with stipulations to provide such data written in leases, tenants are 21often unresponsive to these requirements; and Page 1 of 2 HLS 24RS-4389 ENGROSSED HCR NO. 134 1 WHEREAS, these circumstances have been so unmanageable that HUD has extended 2its March thirty-first deadline to May thirty-first; and 3 WHEREAS, HUD, the United States Department of Energy, and the United States 4Environmental Protection Agency on January 18, 2024, issued a letter explaining the 5situation and encouraging utility providers to provide needed data; and 6 WHEREAS, utility providers are in the best position to aggregate the required energy 7data; and 8 WHEREAS, aggregation of energy consumption data by utility providers negates 9privacy concerns; and 10 WHEREAS, a logical solution would be for utility providers to supply this data to 11their clients. 12 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 13direct all utility providers to develop protocols to facilitate the supplying of aggregate energy 14consumption data to multifamily properties within their respective service area. 15 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 16Public Service Commission and the New Orleans City Council to be distributed to the utility 17providers under their oversight.
