SLS 24RS-395 ORIGINAL 2024 Regular Session SENATE BILL NO. 176 BY SENATOR WHEAT LOTTERIES. Constitutional amendment to provide relative to certain lotteries and certain disbursement of proceeds. (2/3 - CA13s1) 1 A JOINT RESOLUTION 2 Proposing to amend Article XII, Section 6(A)(1) of the Constitution of Louisiana, relative 3 to lotteries; to authorize the creation of three separate lottery games with proceeds 4 from each game dedicated to veterans, senior citizens, and special needs persons; and 5 to specify an election for submission of the proposition to electors and provide a 6 ballot proposition. 7 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members 8 elected to each house concurring, that there shall be submitted to the electors of the state, for 9 their approval or rejection in the manner provided by law, a proposal to amend Article XII, 10 Section 6(A)(1) of the Constitution of Louisiana, to read as follows: 11 ยง6. Lotteries; Gaming, Gambling, or Wagering 12 Section 6.(A) Lotteries. (1)(a) The legislature may provide for the creation 13 and operation of a state lottery and may create a special corporation for that purpose 14 whose employees shall not be subject to state civil service. The Except as provided 15 in Subsubparagraph (b) of this Subparagraph, the net proceeds from the 16 operation of the lottery shall be deposited in a special fund created in the state 17 treasury entitled the Lottery Proceeds Fund. SB NO. 176 SLS 24RS-395 ORIGINAL 1 be appropriated for expenditure in the same calendar year in which they are received. 2 The legislature shall annually appropriate from the fund only for the purposes of the 3 minimum foundation program and no more than five hundred thousand dollars for 4 services related to compulsive and problem gaming as may be provided by law. 5 (b) In addition to the type or types of lottery conducted by the special 6 corporation, the corporation shall provide for the sale of three separate tickets 7 or shares in the lottery with the net proceeds from the sale of each ticket or 8 share to be appropriated to programs for the benefit of veterans, senior citizens, 9 and special needs persons as defined and provided by law. No appropriation for 10 expenditure of lottery proceeds provided in this Subsubparagraph shall be 11 made in the same calendar year in which the funds are received. The 12 determination of programs and persons eligible to receive funds pursuant to 13 this Subsubparagraph shall be provided by law. 14 * * * 15 Section 2. Be it further resolved that this proposed amendment shall be submitted to 16 the electors of the state of Louisiana at the statewide election to be held on November 5, 17 2024. 18 Section 3. Be it further resolved that on the official ballot to be used at the election 19 there shall be printed a proposition, upon which the electors of the state shall be permitted 20 to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as 21 follows: 22 Do you support an amendment to create three separate lottery games with the 23 proceeds from the sale of each dedicated to veterans, senior citizens, and 24 special needs persons? 25 (Amends Article XII, Section 6(A)(1)) The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Alan Miller. Requires that the net proceeds from the operation of the lottery be deposited in a special fund in the state treasury entitled the Lottery Proceeds Fund. Requires that deposits into the fund not be appropriated for expenditure in the same calendar year in which they are received. Requires that the legislature annually appropriate from the fund only for the purposes of the minimum foundation program and no more than $500,000 for services related to compulsive and problem gaming as may be provided by law. Proposed constitutional amendment provides an exception to the use of net proceeds from the operation of the lottery. Requires that the corporation provide for the sale of three separate tickets or shares in the lottery with the net proceeds from the sale of each ticket or share to be appropriated to programs for the benefit of veterans, senior citizens, and special needs persons as defined and provided by law. Prohibits appropriation of the lottery proceeds in the same calendar year in which these funds are received under proposed constitutional amendment. Requires that the determination of programs and persons eligible as veterans, senior citizens, and special needs persons be provided by law.
