SENATE BILL NO. 83

HOSPITALS. Provides relative to hospital service districts. (8/1/24)
1	AN ACT
2 To amend and reenact R.S. 46:1055(7), 1057(5), and 1058, relative to hospital service
3 districts; to provide relative to the powers and duties of the commission; to provide
4 for a medical executive committee; to provide relative to the duties of the director;
5 to provide for the duties of the medical executive committee; and to provide for
6 related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 46:1055(7), 1057(5), and 1058 are hereby amended and reenacted to
9 read as follows:
10 §1055. Powers and duties of commission
11	A. In addition to the duties defined elsewhere in this Chapter, the commission
12 shall have the duty and authority:

14	(7) To appoint the necessary standing and special committees which may be
15 necessary to carry out the purposes of this Chapter. Each hospital service district
16 shall have a medical executive committee.

1 §1057. Duties of director
2	In addition to the duties imposed upon him by other provisions of this
3 Chapter, it shall be the duty of the director:

5	(5) To consult and cooperate with the medical staff and the medical
6 executive committee in the performance of the policies which it may establish.

8 §1058. Medical staff; medical executive committee
9	A. The commission shall appoint a medical staff. Such appointments

11 authorized to practice medicine within the hospital.
12	B. The commission shall appoint a medical executive committee. It shall
13 be the duty of the medical staff executive committee to:
14	(1) To provide Provide professional care of the sick and injured in the
15 hospitals;.
16	(2) To give Give advice and assistance to the commission and director
17 relating to standards of operation and professional problems;.
18	(3) To participate Participate in the educational activities of the district;.
19	(4) To promulgate Promulgate rules and regulations for the conduct of the
20 medical staff for approval of the commission;.
21	(5) To elect Elect annually one of its members as chief of staff and to elect
22 from its members the heads of any specialized medical services of the hospital; and.
23	(6) To approve the appointment of the hospital director made by the
24 commission.

Present law provides for the powers and duties of the boards and commissions governing
hospital service districts. Present law provides that one of the duties is to appoint the
necessary standing and special committees which may be necessary to carry out the purposes

of this Chapter.
Proposed law requires each hospital service district to have a medical executive committee.
Present law provides for the duties of the director of the hospital service district hospital.
Present law provides that the director should cooperate with the medical staff in the
performance of the policies of the district.
Proposed law retains present law and adds that the director should consult and cooperate
with the medical staff and the medical executive committee.
Present law provides for medical staff; how appointments to the medical staff are made; and
the duties of the medical staff.
Proposed law retains present law relative to the medical staff and adds creation of a medical
executive committee. Proposed law retains present law duties of the medical staff and makes
them applicable to the medical executive committee.
Effective August 1, 2024.
