RETIREMENT/STATE EMPS:  Provides for the reemployment of retirees under certain
circumstances in the Louisiana State Employees' Retirement System
1	AN ACT
2To amend and reenact R.S. 11:416(A)(3)(b), relative to the Louisiana State Employees'
3 Retirement System; to provide for the reemployment of retirees; to provide for
4 eligibility; to provide for an exemption from any increase, suspension, or decrease
5 of benefits as a result of reemployment under certain circumstances; and to provide
6 for related matters.
7	Notice of intention to introduce this Act has been published
8	as provided by Article X, Section 29(C) of the Constitution
9	of Louisiana.
10Be it enacted by the Legislature of Louisiana:
11 Section 1. R.S. 11:416(A)(3)(b) is hereby amended and reenacted to read as follows: 
12 ยง416.  Employment of retirees
13	A.  Regardless of age, if a retiree of the system is engaged or hereafter
14 engages in employment which otherwise would render him eligible for membership
15 in the system, he shall choose one of the following irrevocable options:

19	(b)  Notwithstanding the provisions of this Section or any other provision of
20 law to the contrary, any retiree of the system who meets the following requirements

1 shall be exempt from any increase, suspension, or reduction of benefits received
2 from this system as a result of reemployment:
3	(i) has Has at least thirty years of service credited to his account, or twenty-
4 five years of service credited to his account as a P.O.S.T.- certified law enforcement
5 officer.
6	(ii) has Has been retired for at least one year,.
7	(iii) is Is eligible to receive his full retirement benefits,.
8	(iv) and has Has been appointed by the governor to fill an unclassified civil
9 service position. shall be exempt from any increase, suspension or reduction of
10 benefits received from this system as the result of reemployment.

12 Section 2.  The cost of this Act, if any, shall be funded with additional employer
13contributions in compliance with Article X, Section 29(F) of the Constitution of Louisiana.

Abstract:  Provides an exception for certain reemployed retirees in the La. State Employees'
Retirement System (LASERS), from any increase, suspension, or reduction of
benefits as a result of reemployment.
Present law requires a reemployed retiree of the LASERS to meet the following
requirements to be exempt from any benefit increase, suspension, or reduction during
reemployment:
(1)30 years of creditable service.
(2)Retired for one year.
(3)Is eligible to receive his full retirement benefit.
(4)Appointed by the governor to fill an unclassified civil service position.
Proposed law reduces the service credit requirement for P.O.S.T.-certified law enforcement
officers to 25 years of service.
Proposed law requires that any cost of proposed law be funded with additional employer
contributions in compliance with the present constitution (Art. X, Sec. 29(F)).
