COUNCILS ON AGING: Modifies the funding formula used to determine minimum state funding allocations to parish councils on aging and increases the minimum aggregate total that is to be appropriated annually to the office of elderly affairs for such allocations 1 AN ACT 2To amend and reenact R.S. 46:1606(A) and (B)(1), relative to state funding for parish 3 councils on aging; to modify the funding formula for determining annual state 4 funding for each such council; to provide for distribution of such funding; to provide 5 minimum amounts to be appropriated for such funding; to provide for applicability; 6 to provide for an effective date; and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 46:1606(A) and (B)(1) are hereby amended and reenacted to read as 9follows: 10 ยง1606. Annual appropriation 11 A. The legislature shall appropriate to the office of elderly affairs, for 12 distribution by the executive director of the office to the various voluntary parish 13 councils on aging, funds sufficient to allocate to each parish council two four dollars 14 and fifty cents for each person sixty years or older who is a resident of the parish as 15 shown by the latest official census estimate or one hundred fifty thousand dollars, 16 whichever is greater. The office of elderly affairs shall include funds in their annual 17 budget request for increases in funding based on the number of elderly as estimated 18 in the above census. HLS 25RS-568 ORIGINAL HB NO. 126 1 shall be for a minimum of six million nine hundred thousand ten million four 2 hundred ninety-four thousand two hundred thirty-eight dollars. 3 B.(1) Funds appropriated by the legislature pursuant to Subsection A of this 4 Section shall be distributed by the executive director of the office of elderly affairs 5 and shall be allocated to each parish council in an amount equal to two four dollars 6 and fifty cents for each resident of the parish age sixty years or older, as shown by 7 the latest official estimate approved by the United States Bureau of the Census, or 8 one hundred fifty thousand dollars, whichever is greater. The sums so allocated shall 9 be distributed quarterly during the first thirty days of each quarter of the fiscal year. 10 In appropriating funds pursuant to this Section, the legislature shall specifically 11 provide for the allocation of funds to the respective parish councils in accordance 12 with the provisions of this Section. 13 * * * 14 Section 2. No provision of this Act shall apply to appropriations for Fiscal Year 152025-2026. 16 Section 3. This Act shall become effective on July 1, 2025, and, if not signed by the 17governor, upon expiration of the time for bills to become law without signature by the 18governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If vetoed 19by the governor and subsequently approved by the legislature, this Act shall become 20effective on the day following such approval. Further increases the aggregate total minimum appropriation for such funding. Present law establishes a funding formula for distribution of state funding to parish councils on aging. Requires such funding to be distributed quarterly by the office of elderly affairs to each parish council on aging. HLS 25RS-568 ORIGINAL HB NO. 126 Present law requires such funding to be distributed in an amount equal to $2.50 for each resident of the parish age 60 or older as of the latest federal decennial census or $100,000, whichever amount is greater. Proposed law retains present law but increases the minimum per resident amount from $2.50 to $4.00 and increases the standard per parish minimum amount from $100,000 to $150,000. Present law requires the minimum total annual appropriation for such distributions to be $6,900,000. Proposed law increases this amount to $10,494,238. Proposed law limits applicability to appropriations for fiscal years after 2025-2026. Effective July 1, 2025.
