CRIME/HOMICIDE:  Provides relative to homicide when the victim is a person with
infirmities
1	AN ACT
2To amend and reenact R.S. 14:30(A)(1) and 30.1(A)(2), relative to homicide; to add cruelty
3 to persons with infirmities as a predicate felony to first and second degree murder;
4 and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 14:30(A)(1) and 30.1(A)(2) are hereby amended and reenacted to
7read as follows: 
8 §30.  First degree murder
9	A.  First degree murder is the killing of a human being:
10	(1)  When the offender has specific intent to kill or to inflict great bodily
11 harm and is engaged in the perpetration or attempted perpetration of aggravated
12 kidnapping, second degree kidnapping, aggravated escape, aggravated arson,
13 aggravated or first degree rape, forcible or second degree rape, aggravated burglary,
14 armed robbery, assault by drive-by shooting, first degree robbery, second degree
15 robbery, simple robbery, terrorism, cruelty to juveniles, or second degree cruelty to
16 juveniles, or cruelty to persons with infirmities.

1	(2)  When the offender is engaged in the perpetration or attempted
2 perpetration of aggravated or first degree rape, forcible or second degree rape,
3 aggravated arson, aggravated burglary, aggravated kidnapping, second degree
4 kidnapping, aggravated escape, assault by drive-by shooting, armed robbery, first
5 degree robbery, second degree robbery, simple robbery, cruelty to juveniles, second
6 degree cruelty to juveniles, cruelty to persons with infirmities, or terrorism, even
7 though he has no intent to kill or to inflict great bodily harm.

Abstract:  Adds "cruelty to persons with infirmities" to the list of crimes which, when
committed during a homicide, result in first or second degree murder.
Present law provides that first degree murder is when an offender has specific intent to kill
or inflict great bodily harm and is engaged in the perpetration or attempted perpetration of
certain crimes.
Proposed law adds "cruelty to persons with infirmities" to that list of crimes.
Present law provides that second degree murder is the killing of a human being when the
offender is engaged in the perpetration or attempted perpetration of certain crimes, even
when the offender has no intent to kill or inflict great bodily harm.
Proposed law adds "cruelty to persons with infirmities" to that list of crimes.
