HOUSE BILL NO. 162
BY REPRESENTATIVE LAFLEUR
DISTRICTS/REDEVELOPMENT:  Provides relative to the East Baton Rouge
Redevelopment Authority
1	AN ACT
2To amend and reenact R.S. 33:4720.151(H)(3), relative to East Baton Rouge Parish; to
3 provide relative to the East Baton Rouge Redevelopment Authority; to provide
4 relative to the powers and duties of the authority; and to provide for related matters.
5	Notice of intention to introduce this Act has been published
6	as provided by Article III, Section 13 of the Constitution of
7	Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 33:4720.151(H)(3) is hereby amended and reenacted to read as
10follows:
11 ยง4720.151.  East Baton Rouge Redevelopment Authority

13	H.  The authority, through the board, shall have all powers necessary or
14 convenient to carry out and effectuate the purposes and provisions of this Chapter,
15 including but not limited to the following:

17	(3)  To acquire by gift, grant, purchase, lease, or otherwise and to hold and
18 use any property, real, personal, mixed, tangible, or intangible, or any interest
19 therein, necessary or desirable for carrying out the objects and purposes of the
20 authority, and to engage in any action, such as the purchase of insurance, necessary

1 or desirable for the maintenance or improvement of such property.  The authority
2 shall not have any power to expropriate, except that power which is granted by the
3 appropriate governing authority may expropriate property as a means to revitalize
4 economically depressed areas by placing abandoned or blighted property back into
5 the economic stream of commerce through rehabilitation of the abandoned or
6 blighted property.

Abstract:  Provides relative to the powers and duties of the East Baton Rouge
Redevelopment Authority.
Present law creates and provides for the East Baton Rouge Redevelopment Authority as a
political subdivision of the state to provide for the utilization of appropriate private and
public resources to eliminate and prevent the development or spread of slum, blighted, and
distressed areas.  Provides that the object of present law is to provide a unified and
comprehensive response to the housing shortages and other indirect effects of Hurricanes
Katrina and Rita upon south central La.  Provides that the authority shall be comprised of
all the territory in the parish, including the territory comprising the municipalities of Baker,
Baton Rouge, Central, and Zachary.  Provides that the authority is governed by a
five-member board of commissioners.
Proposed law retains present law.
Present law provides for the powers and duties of the authority, including the power to
acquire by gift, grant, purchase, lease, or otherwise and to hold and use any property, real,
personal, mixed, tangible, or intangible, or any interest therein, necessary or desirable for
carrying out the objects and purposes of the authority.  Proposed law retains present law.
Present law provides that the authority shall not have any power to expropriate, except that
power which is granted by the appropriate governing authority.
Proposed law removes present law and provides that the authority may expropriate property
as a means to revitalize economically depressed areas by placing abandoned or blighted
property back into the economic stream of commerce through rehabilitation of the
abandoned or blighted property.
