HOUSE BILL NO. 191

DISTRICTS/CRIME PREVENT:  Provides relative to the Lakewood Crime Prevention and
Improvement District in Orleans Parish
1	AN ACT
2To amend and reenact R.S. 33:9091.8(F)(2)(a) and (4)(c) and to repeal R.S.
3 33:9091.8(F)(4)(b), relative to Orleans Parish; to provide relative to the Lakewood
4 Crime Prevention and Improvement District; to provide relative to the parcel fee
5 levied within the district; to provide for the maximum fee amount; to provide for the
6 expiration and renewal of the fee; to provide for an effective date; and to provide for
7 related matters.
8	Notice of intention to introduce this Act has been published
9	as provided by Article III, Section 13 of the Constitution of
10	Louisiana.
11Be it enacted by the Legislature of Louisiana:
12 Section 1.  R.S. 33:9091.8(F)(2)(a) and (4)(c) are hereby amended and reenacted to
13read as follows:

16	F.  Parcel fee.

18	(2)(a)  For purposes of this Section, a parcel is defined as a lot or lots upon
19 which only one main house is situated.  The fee shall be a flat fee and shall be
20 imposed on each parcel located within the district.  The amount of the fee shall be

1 as determined by duly adopted resolution of the board and shall not exceed four
2 hundred fifty six hundred dollars per parcel per year.

6	(c)  The fee shall expire on December thirty-first after the 2010 mayoral
7 election for the city of New Orleans, but the fee may be renewed or the maximum
8 amount of the fee provided in Paragraph (2) of this Subsection may be changed if
9 approved by a majority of the registered voters of the district voting on the
10 proposition at an election as provided in Subparagraph (a) of this Paragraph.  Any
11 election to authorize renewal of the fee or change of the maximum fee amount shall
12 be held for that purpose in accordance with the Louisiana Election Code.  If the fee
13 is renewed or the maximum amount thereof changed, the term of the imposition of
14 the fee shall be as provided in the proposition authorizing such renewal or change,
15 not to exceed eight years at the time provided in the proposition authorizing the fee,
16 not to exceed eight years, but the fee may be renewed as provided in Subparagraph
17 (a) of this Paragraph.  Any election to authorize renewal of the fee shall be held for
18 that purpose in accordance with the Louisiana Election Code.  If the fee is renewed,
19 the term of the imposition of the fee shall be as provided in the proposition
20 authorizing the renewal, not to exceed eight years.

22 Section 2.  R.S. 33:9091.8(F)(4)(b) is hereby repealed in its entirety.
23 Section 3.  This Act shall become effective upon signature by the governor or, if not
24signed by the governor, upon expiration of the time for bills to become law without signature
25by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
26vetoed by the governor and subsequently approved by the legislature, this Act shall become
27effective on the day following such approval.

Abstract:  Relative to the Lakewood Crime Prevention and Improvement District in Orleans
Parish, increases the maximum amount of the parcel fee authorized to be levied
within the district.
Present law creates the Lakewood Crime Prevention and Improvement District in Orleans
Parish as a political subdivision to aid in crime prevention by providing security for district
residents and funding beautification and other activities and improvements for the overall
betterment of the district.  Provides for district boundaries, governance, and powers and
duties.
Proposed law retains present law.
Present law authorizes the governing authority of the city of New Orleans to impose and
collect a parcel fee within the district.  Provides that the fee amount shall be as requested by
duly adopted resolution of the board, not to exceed $450 per parcel per year.  Requires that
the fee be imposed on each parcel within the district, including parcels upon which there is
no structure.
Proposed law increases the amount of the maximum fee authorized to be imposed within the
district from $450 to $600 per parcel per year.  Proposed law otherwise retains present law.
Present law provides that the initial election on the question of the fee shall be held at the
same time as the regularly scheduled election in the city on November 2, 2004, or a regularly
scheduled election in the city held after that date.  Proposed law removes present law.
Present law provides that the fee expires on December 31
st
 after the 2010 mayoral election
for the city of New Orleans.
Proposed law removes present law and provides that the fee expires at the time provided in
the proposition authorizing the fee, not to exceed eight years.
Present law authorizes renewal of the fee for a term provided in the proposition, not to
exceed eight years.  Proposed law retains present law.
Effective upon signature of governor or lapse of time for gubernatorial action.
