CRIMINAL/PENALTIES:  Provides relative to the financial obligations of criminal
offenders
1	AN ACT
2To amend and reenact Code of Criminal Procedure Article 875.1(G), relative to the financial
3 obligations for criminal offenders; to provide for misdemeanors as applicable
4 offenses for which a determination of substantial financial hardship may be
5 considered; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  Code of Criminal Procedure Article 875.1(G) is hereby amended and
8reenacted to read as follows:
9 Art. 875.1.  Determination of substantial financial hardship to the defendant

11	G.  The provisions of this Article shall apply only to defendants convicted of
12 offenses classified as felonies or misdemeanors under applicable law.

Abstract: Provides relative to the financial obligations of criminal offenders.
Present law provides for a determination of substantial financial hardship relative to the
imposition and enforcement of financial obligations imposed upon an offender as part of a

criminal sentence, incarceration, or as a condition of the offender's release on probation or
parole.
Proposed law retains present law.
Present law applies only to defendants convicted of offenses classified as felonies under
applicable law.
Proposed law retains present law and adds misdemeanors as offenses to which present law
is applicable.
