Prefiled pursuant to Article III, Section 2(A)(4)(b)(i) of the Constitution of Louisiana.
CRIME/HOMICIDE:  Provides relative to second degree murder
1	AN ACT
2To amend and reenact R.S. 14:30.1(A)(2) and to enact R.S. 14:30.1(A)(5), relative to
3 offenses against the person; to provide relative to the crime of second degree murder;
4 to add resisting a police officer with force or violence as a predicate felony to second
5 degree murder; to provide for an additional circumstance that constitutes second
6 degree murder; to provide for an effective date; and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 14:30.1(A)(2) is hereby amended and reenacted and R.S.
914:30.1(A)(5) is hereby enacted to read as follows: 
10 ยง30.1.  Second degree murder
11	A.  Second degree murder is the killing of a human being:

13	(2)  When the offender is engaged in the perpetration or attempted
14 perpetration of aggravated or first degree rape, forcible or second degree rape,
15 aggravated arson, aggravated burglary, aggravated kidnapping, second degree
16 kidnapping, aggravated escape, resisting a police officer with force or violence,
17 assault by drive-by shooting, armed robbery, first degree robbery, second degree
18 robbery, simple robbery, cruelty to juveniles, second degree cruelty to juveniles, or
19 terrorism, even though he has no intent to kill or to inflict great bodily harm.

1	(5)  When committed by a person who is in, or who has escaped from, the
2 lawful custody of a law enforcement officer or a place of lawful confinement, even
3 though he has no intent to kill or inflict great bodily harm.

5 Section 2.  This Act shall become effective upon signature by the governor or, if not
6signed by the governor, upon expiration of the time for bills to become law without signature
7by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
8vetoed by the governor and subsequently approved by the legislature, this Act shall become
9effective on the day following such approval.

Abstract: Provides relative to second degree murder.
Present law (R.S. 14:30.1) provides for the crime of second degree murder.
Proposed law retains present law.
Present law (R.S. 14:30.1(A)(2)) provides for a list of offenses that constitute second degree
murder even when the offender has no intent to kill or to inflict great bodily harm.
Proposed law retains present law and adds resisting a police officer with force or violence
to this list.
Proposed law provides that an additional circumstance of second degree murder is the killing
of a human when committed by a person who is in, or who has escaped from, the lawful
custody of a law enforcement officer or a place of lawful confinement, even though he has
no intent to kill or inflict great bodily harm.
Effective upon signature of governor or lapse of time for gubernatorial action.
(Amends R.S. 14:30.1(A)(2); Adds R.S. 14:30.1(A)(5))
