HOUSE BILL NO. 309

APPROPRIATIONS/GENERAL:  Provides for limitations on appropriations to
nongovernmental entities
1	AN ACT
2To amend and reenact R.S. 39:51.1(A)(1)(a), (C), and (E) and to enact R.S. 39:51(H),
3 relative to appropriations to nongovernmental entities; to provide limitations on
4 funding to nongovernmental entities through an appropriation bill; to provide for
5 information required by nongovernmental entities; to provide for an effective date;
6 and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 39:51.1(A)(1)(a), (C), and (E) are hereby amended and reenacted and
9R.S. 39:51(H) is hereby enacted to read as follows:
10 §51.  General Appropriation Bill; other appropriation bills

12	H. The General Appropriation Bill, capital outlay bill, or any appropriation
13 bill that contains an appropriation for a budget unit or a political subdivision of the
14 state shall not include an appropriation for a nongovernmental entity which is neither
15 a budget unit nor a political subdivision of the state.
16 §51.1.  General Appropriation Bill and other appropriation bills; nongovernmental
17	entity funding request form; exemptions
18	A.(1)(a)  No later than the first day of November each year any
19 nongovernmental entity which is neither a budget unit nor a political subdivision of
20 the state that is requesting funding from the state through the General Appropriation

1 Bill, capital outlay bill, or any supplemental appropriation bill shall transmit certain
2 information relative to such proposed funding to the House Committee on
3 Appropriations, the House Committee on Ways and Means, the Senate Committee
4 on Finance, and the Senate Committee on Revenue and Fiscal Affairs in a form and
5 manner as shall be prescribed jointly by the committees.

7	C.  Requests Except as provided in R.S. 39:51(H), requests submitted after
8 November first of each year may be included within an appropriation bill if the late
9 submission is approved by the Joint Legislative Committee on the Budget or the
10 Joint Legislative Committee on Capital Outlay prior to the last day for introduction
11 of a matter intended to have the effect of law by either house of the legislature.
12 Requesting entities shall submit all applicable information prior to such approval.

14	E.  A completed nongovernmental entity funding request form shall be
15 submitted for each entity which is neither a budget unit nor a political subdivision
16 of the state and for which funding is provided in an appropriation bill, in conformity
17 with R.S. 39:51(H), either upon introduction or through an amendment in accordance
18 with the rules of the respective house.

20 Section 2. This Act shall become effective July 1, 2025.

Abstract: Requires an appropriation to a nongovernmental entity to be in an appropriation
bill that only appropriates money to nongovernmental entities.
Present law requires the legislature to introduce a General Appropriation Bill for the
ordinary operating expenses of government, and appropriation bills for the ancillary
expenses of government, the legislature, and the judiciary. Provides for appropriations for
a nongovernmental entity (NGO) to be made through the General Appropriation Bill, the
capital outlay bill, or any supplemental appropriation bill.

Proposed law removes the authorization for an appropriation to be made to an NGO through
the General Appropriation Bill, capital outlay bill, or any supplemental appropriation bill.
Prohibits an appropriation made for an NGO to include in a bill that contains an
appropriation to a budget unit or a political subdivision of the state.
Effective July 1, 2025.
