COSMETOLOGY/BOARD: Provides relative to the Louisiana Cosmetology Act 1 AN ACT 2To amend and reenact R.S. 37:571(B), 572(B) through (E), and 599(A)(2), (5), and (6), 3 relative to the Louisiana Cosmetology Act; to provide for membership of the state 4 board of cosmetology; to provide for the qualifications of board members; to provide 5 for fees; to provide for an effective date; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 37:571(B), 572(B) through (E), and 599(A)(2), (5), and (6) are 8hereby amended and reenacted to read as follows: 9 §571. Louisiana State Board of Cosmetology; creation; domicile; membership 10 * * * 11 B. The board shall be composed of eight members appointed by the 12 governor, who shall serve at the pleasure of the governor., with the following 13 qualifications: 14 (1) At least one member shall be appointed from each congressional district. 15 (2) At least one member shall be primarily engaged in the practice of 16 cosmetology. 17 (3) One member shall be a licensed esthetician. 18 (4) One member shall be a licensed manicurist. 19 * * * Page 1 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. Each member shall be one of the following: a registered cosmetologist 4 who has been actively engaged, for at least five years prior to his appointment, in the 5 practice of cosmetology, or an owner of a beauty shop or salon certified pursuant to 6 R.S. 37:591, or as a teacher or instructor of cosmetology in this state. 7 (1) A registered cosmetologist, esthetician, or manicurist who has been 8 actively engaged, for at least five years prior to his appointment, in the practice of 9 cosmetology, esthetics, or manicuring. However, no more than one esthetician and 10 one manicurist shall serve on the board. 11 (2) An owner of a beauty shop or salon certified pursuant to R.S. 37:591. 12 (3) An owner of an accredited cosmetology school, who has been the owner 13 for more than five years. 14 (4) A teacher or instructor of cosmetology in this state. 15 C. The board members shall not all be graduates of the same school ensuring 16 diverse educational representation. 17 D. No To prevent conflicts of interest, no more than four board members 18 shall be connected directly or indirectly with a school of cosmetology. "Connected" 19 means having an ownership interest in a school, being employed by a school, or 20 having a contract contractual relationship with a school, or having an immediate 21 family member who has an ownership interest in a school. 22 E. Any board member, who in the discharge of a duty or responsibility of his 23 office or position would be required to vote on a matter which would cause him to 24 be encounters a situation where voting would result in a violation of the Code of 25 Governmental Ethics, shall recuse himself from voting on the matter. 26 * * *§599. This Act shall become effective upon signature by the governor or, if not 10signed by the governor, upon expiration of the time for bills to become law without signature 11by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 12vetoed by the governor and subsequently approved by the legislature, this Act shall become 13effective on the day following such approval. Present law for the membership of the Board of Cosmetology (board). Proposed law amends present law to require that at least one member shall be primarily engaged in the practice of cosmetology, one member shall be a licensed esthetician, and one member shall be a licensed manicurist. Present law provides for the qualifications of board members. Proposed law amends present law to require members to be one of the following: (1)A registered cosmetologist, esthetician, or manicurist who has been actively engaged, for at least 5 years prior to his appointment, in the practice of cosmetology, esthetics, or manicuring. However, no more than one esthetician and one manicurist shall serve on the board. (2)An owner of a beauty shop or salon certified pursuant to present law. (3)An owner of an accredited cosmetology school, who has been the owner for more than five years. (4)A teacher or instructor of cosmetology in this state. Proposed law amends present law with clarification language. Present law provides for fees for a cosmetologist, esthetician, manicurist, teacher/instructor and manager for both residents and nonresidents. Proposed law amends present law to make a base fee of $50. Present law provides for fees for a beauty shop or salon, mobile salon, and home care for both residents and nonresidents. Proposed law amends present law to make a base fee of $55. Present law provides that the initial inspection fee for salon, mobile salon, or booth rental shall be $25. Proposed law increases the fee from $25 to $50. Present law provides for fees for special permit and temporary permit. Proposed law repeals present law. Present law provides that the fee for initial certificate of registration for a school be $315 for a resident and $615 for a nonresident. Proposed law amends present law to make it a base fee of $340. Present law provides that the fee for a renewal of certificate of registration for a school for a resident be $165 and for a nonresident be $465. Proposed law amends present law to make it a base fee of $190. Present law provides that the fee for failure to timely renew be $150. Proposed law increases the fee from $150 to $175. Effective upon signature of governor or lapse of time for gubernatorial action.
