PUBLIC SERVICE COMN:  (Constitutional Amendment) Increases the membership of the
Public Service Commission
1	A JOINT RESOLUTION
2Proposing to amend Article IV, Section 21(A) of the Constitution of Louisiana, relative to
3 the membership of the Public Service Commission; to provide for an increase to the
4 membership of the Public Service Commission; to provide for submission of the
5 proposed amendment to the electors; and to provide for related matters.
6 Section 1.  Be it resolved by the Legislature of Louisiana, two-thirds of the members
7elected to each house concurring, that there shall be submitted to the electors of the state of
8Louisiana, for their approval or rejection in the manner provided by law, a proposal to
9amend Article IV, Section 21(A) of the Constitution of Louisiana, to read as follows:
10 §21.  Public Service Commission
11	Section 21.(A)(1)  Composition; Term; Domicile.  There shall be a Public
12 Service Commission in the executive branch.  It shall consist of five members, who
13 seven members.
14	(a)  Five members shall be elected for overlapping terms of six years at the
15 time fixed for congressional elections from single member districts established by
16 law.  
17	(b)  Two members shall be appointed by the governor, approved by the
18 Senate, and shall serve at the pleasure of the governor, not to exceed two consecutive
19 four-year terms.  The two gubernatorial appointments shall not serve a district, but
20 shall be from the state-at-large.

1	(2)  The commission annually shall elect one member as chairman.  It shall
2 be domiciled at the state capital, but may meet, conduct investigations, and render
3 orders elsewhere in this state.
4	(2)(3) No person who has served as a member of the commission for more
5 than two and one-half terms in three consecutive terms shall be elected to the
6 commission for the succeeding term.  This Subparagraph shall not apply to any
7 person elected to the commission prior to the effective date of this Subparagraph,
8 except that it shall apply to any term of service of any such person that begins after
9 such date.

11 Section 2.  Be it further resolved that this proposed amendment shall be submitted
12to the electors of the state of Louisiana at the statewide election to be held on November 3,
132026.
14 Section 3.  Be it further resolved that on the official ballot to be used at the election,
15there shall be printed a proposition, upon which the electors of the state shall be permitted
16to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
17follows:
18	Do you support an amendment to increase the membership of the Public
19	Service Commission by two members, appointed by the governor, to
20	represent the state-at-large? (Amends Article IV, Section 21(A))

Abstract: Increases the membership of the Public Service Commission from 5 to 7.
Present constitution provides that there shall be five members of the Public Service
Commission (commission) that shall be elected for overlapping terms of six years at the time
fixed for congressional elections from single member districts established by law.
Proposed constitution changes present constitution by providing that the commission shall
increase to seven members. Proposed constitution adds that the governor shall appoint two
members of the commission, confirmed by the Senate, that shall serve the state-at-large.

Present constitution provides that no person who has served as a member of the commission
for more than two and one-half terms in three consecutive terms shall be elected to the
commission for the succeeding term.  Present constitution provides that this applies to
individuals elected before a certain date.
Proposed constitution retains present constitution but removes applicability language.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held November 3, 2026.
