CORRECTIONS/PRISONERS: Provides relative to the amount DPS&C pays for the housing of state inmates in a parish jail or institution 1 AN ACT 2To amend and reenact R.S. 15:824(B)(1)(a), relative to the confinement of inmates; to 3 provide relative to persons committed to the custody of the Department of Public 4 Safety and Corrections who are confined in a parish jail or institution; to increase the 5 amount the Department of Public Safety and Corrections pays for the confinement 6 of persons in parish jails or institutions; and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 15:824(B)(1)(a) is hereby amended and reenacted to read as follows: 9 ยง824. Commitment of persons to the Department of Public Safety and Corrections 10 * * * 11 B.(1)(a) In the event any individual has been committed to the department 12 for confinement which is or has been delayed or prevented after final sentence by 13 court order restricting the department from institutionalizing the individual, or when 14 the individual is not institutionalized in a state penal or corrections institution 15 because of lack of facilities under the control of the department, or the department 16 otherwise refused to accept the individual for confinement, which resulted or has 17 resulted in the individual being confined in a parish jail or institution after final 18 sentence, or when he is being held in the parish jail without bail, pending an appeal, 19 or when he is a participant in a Blue Walters Substance Abuse Program by order of 20 a court in lieu of revocation of probation or by the committee on parole in lieu of 21 revocation of parole, the department shall pay to each parish sheriff, or to the Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 25RS-924 ORIGINAL HB NO. 388 1 governing authority of those parishes in which the governing authority operates the 2 parish jail, for keeping and feeding the individual in the parish jail the sum of 3 twenty-five dollars and thirty-nine cents per day for Fiscal Year 2019-2020, the sum 4 of twenty-six dollars and thirty-nine cents per day for Fiscal Year 2020-2021, and 5 each fiscal year thereafter thirty-five dollars per day for Fiscal Year 2025-2026, the 6 sum of thirty-seven dollars per day for Fiscal Year 2026-2027, the sum of thirty-nine 7 dollars per day for Fiscal Year 2027-2028, the sum of forty dollars per day for Fiscal 8 Year 2028-2029, and each fiscal year thereafter. Such daily sum shall be paid from 9 date of sentencing until the individual is confined in a penal or correctional 10 institution under the supervision of the department. The department shall work with 11 sheriffs, or the governing authority of those parishes in which the governing 12 authority operates the parish jail, to ensure that the basic jail guidelines are amended 13 by December 31, 2020, to specifically provide for treatment and educational 14 programming for individuals confined in a parish jail or institution. 15 * * * DIGEST The digest printed below was prepared by House Legislative Services. Present law provides that the DPS&C shall pay $25.39 per day for the confinement of persons in parish jails or institutions for Fiscal Year 2019-2020. Present law provides that the DPS&C shall pay $26.39 per day for the confinement of persons in parish jails or institutions for Fiscal Year 2020-2021 and each fiscal year thereafter.
