PUBLIC RECORDS:  Provides relative to expungement of agency records
1	AN ACT
2To enact R.S. 49:988, relative to expungement; to provide for prerequisites for the
3 expungement of agency records; and to provide for related matters.
4Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 49:988 is hereby enacted to read as follows: 
6 ยง988.  Expungement; eligibility
7	A person may request expungement of agency records relative to a consent
8 judgment or complaint filed against a person in which it is alleged that the person
9 violated one or more provisions of law if either of the following has occurred:
10	(1)  The attorney general found that the interpretation of law relied upon by
11 the agency and which resulted in the consent agreement was erroneous.
12	(2)  The agency issued charges based on the complaint that, at the conclusion
13 of enforcement proceedings, did not result in a finding of a violation of the law.

Abstract: Provides for the expungement of agency records in certain instances.
Proposed law provides that a person may request agency records related to a consent
judgment or complaint filed against them to be expunged if the attorney general finds the
law relied upon to be erroneous or if the agency complaint did not result in a finding of a
violation of the law.
