HOUSE BILL NO. 459

ENERGY/ALTERNATE:  Provides for renewable energy regulation and permitting
1	AN ACT
2To enact Part I and Part II of Chapter 12 of Title 30 of the Louisiana Revised Statutes of
3 1950, to be comprised of R.S. 30:1131 and 1141, relative to renewable energy
4 development; to require certain permits for renewable energy producers; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  Part I and Part II of Chapter 12 of Title 30 of the Louisiana Revised
8Statutes of 1950, comprised of R.S. 30:1131 and 1141, are hereby enacted to read as follows:
9	CHAPTER 12.  RENEWABLE ENERGY STORAGE
10	PART I.  BATTERIES
11 §1131.  Permits for renewable energy batteries
12	A.  No battery used for renewable energy storage facilities shall be installed
13 without the operator first obtaining a permit for installation from the Department of
14 Energy and Natural Resources.
15	B.  No permit shall be issued without proof of financial security and a
16 decommissioning plan.
17	C.  The secretary shall be authorized to promulgate and adopt such rules and
18 regulations as are necessary to implement this Section.

2 §1141.  Permits for wind energy
3	A.  No onshore wind project shall be constructed or completed without a
4 permit issued by the Department of Energy and Natural Resources.
5	B.  No permit shall be issued without proof of financial security and a
6 decommissioning plan.
7	C.  The secretary shall be authorized to promulgate and adopt such rules and
8 regulations as are necessary to implement this Section.

Abstract:  Requires permits from the Department of Energy and Natural Resources for
renewable energy projects.
Proposed law requires operators of renewable energy storage facilities to obtain a permit for
installation and decommissioning from the Dept. of Energy and Natural Resources (DENR)
prior to installing a battery.
Proposed law requires a permit to construct or complete an onshore wind project from the
DENR.
Proposed law prohibits the issuance of a permit for renewable energy projects without proof
of financial security and a decommissioning plan.
Proposed law requires the secretary of the dept. to promulgate and adopt regulations
necessary for the enforcement of proposed law.
