JUDGES:  (Constitutional Amendment) Provides relative to the mandatory retirement of
judges
1	A JOINT RESOLUTION
2Proposing to amend Article V, Section 23(B) of the Constitution of Louisiana, to remove the
3 age limitation for judges to serve in the office of judge and to provide that a judge
4 shall not remain in office after reaching one hundred percent of his final average
5 compensation; to provide for applicability; to provide for submission of the proposed
6 amendment to the electors; and to provide for related matters.
7 Section 1.  Be it resolved by the Legislature of Louisiana, two-thirds of the members
8elected to each house concurring, that there shall be submitted to the electors of the state of
9Louisiana, for their approval or rejection in the manner provided by law, a proposal to
10amend Article V, Section 23(B) of the Constitution of Louisiana, to read as follows:
11 §23.  Judges; Retirement

14	(B)  Mandatory Retirement.  (1)  Except as otherwise provided in this
15 Section, a judge shall not remain in office beyond his seventieth birthday the date he
16 attains one hundred percent of his final average compensation from the judicial
17 retirement system.  A judge who attains seventy years of age becomes eligible to
18 receive one hundred percent of his final average compensation from the judicial
19 retirement system while serving a term of office shall be allowed to complete that
20 term of office.

1	(2)  The provisions of this Paragraph shall apply to all judges sworn in to the
2 office of judge on or after January 1,1997.
3 Section 2.  Be it further resolved that this proposed amendment shall be submitted
4to the electors of the state of Louisiana at the statewide election to be held on November 3,
52026, or at a statewide election authorized by law, whichever occurs first.
6 Section 3.  Be it further resolved that on the official ballot to be used at the election,
7there shall be printed a proposition, upon which the electors of the state shall be permitted
8to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
9follows:
10	Do you support an amendment to remove the age limitation for judges to
11	serve in the office of judge and to provide that a judge sworn in to the office
12	of judge on or after January 1,1997, shall not remain in office after reaching
13	his maximum retirement  compensation?  (Amends Article V, Section 23(B))

Abstract:  Removes the age limitation for judges to serve in the office of judge and provides
that a judge shall not remain in office after reaching his maximum retirement 
compensation.
Present constitution provides that a judge shall not remain in office beyond his 70th birthday,
but also provides that he may remain in office until the completion of his term if he attains
70 years of age while serving a term of office.
Proposed constitutional amendment removes the present constitution age limitation and
provides that a judge shall not remain in office after reaching his maximum retirement 
compensation.
Proposed constitutional amendment applies to all judges sworn in to the office of judge on
or after Jan. 1,1997.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held Nov. 3, 2026, or at a statewide election authorized by law, whichever occurs first.
