HOUSE BILL NO. 630

MTR VEHICLE/DRIVER LIC:  Reduces the fee applicable to updating a driver's license
to comply with REAL ID  standards
1	AN ACT
2To amend R.S. 32:412(A)(1), (2), (5) and (6) and (B)(1) and (2) and (7)(e)(i)(dd)(I) and (ee),
3 and (ii)(dd)(I), relative to driver's licenses updated to be compliant with REAL ID
4 standards; to reduce the fees for applicants updating their license to obtain the REAL
5 ID credential; to preserve the original renewal date on the updated license; prohibits
6 the reduced fee from being applied towards contribution payments; and to provide
7 for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S.32:412(A)(1), (2), (5) and (6) and (B)(1) and (2) and (7)(e)(i)(dd)(I)
10and (ee), and (ii)(dd)(I) are hereby amended and reenacted to read as follows:
11 ยง412.  Amount of fees; credit or refund; duration of license; veteran designation;
12	special needs or accommodation designations; disbursement of funds;
13	renewal by mail or electronic commerce of Class "D" or "E" drivers' licenses;
14	disposition of certain fees; exception
15	A.(1)  Every applicant for a Class "D" driver's license, or for a renewal of a
16 Class "D" driver's license, except those bona fide residents of the city of New
17 Orleans and applicants updating this credential to comply with REAL ID standards,
18 shall pay for such basic license a fee of forty-two dollars and seventy-five cents.
19 Notwithstanding any other provision of law to the contrary, the fee for an applicant
20 updating a Class "D" driver's license to become REAL ID compliant shall be ten

1 dollars, and this fee shall be exempt from the contributions specified in this
2 Paragraph.  The renewal date on the original license shall remain unchanged on the
3 updated license.  Eleven dollars and fifteen cents of the basic license fee shall be paid
4 to the Louisiana State Police Retirement System Fund.  One dollar and fifty cents of
5 the basic license fee shall be forwarded by the department to the litter abatement
6 account which is created within the Conservation Fund through the provisions of
7 R.S. 56:10(B)(15).
8	(2)  The fee for Class "D" driver's licenses, or renewal of a Class "D" driver's
9 license, issued to bona fide residents of the city of New Orleans, except those
10 applicants updating this credential to comply with REAL ID standards shall be fifty-
11 four dollars, .  Notwithstanding any other provision of law to the contrary, the fee for
12 bona fide residents of the city of New Orleans updating a Class "D"driver's license
13 to become REAL ID compliant shall be ten dollars, and this fee shall be exempt from
14 the contributions specified in this Paragraph.  The renewal date on the original
15 license shall remain unchanged on the updated license.  fifteen Fifteen dollars of
16 which the basic license fee shall be payable by the department to the board of
17 trustees of the police pension fund of the city of New Orleans.  One dollar and
18 eighty-four cents of the basic license fee shall be paid to the Louisiana State Police
19 Retirement System Fund.  One dollar and fifty cents of the basic license fee shall be
20 forwarded by the department to the litter abatement account which is created within
21 the Conservation Fund through the provisions of R.S. 56:10(B)(15).

23	(5)  Every applicant for a Class "E" driver's license, or for a renewal of a
24 Class "E" driver's license, except those bona fide residents of the city of New
25 Orleans and applicants updating this credential to comply with REAL ID standards,
26 shall pay for such basic license a fee of twenty dollars and twenty-five cents, which
27 shall be the cost of such basic license.  Notwithstanding any other provision of law
28 to the contrary, the fee for an applicant updating a Class "E" driver's license to
29 become REAL ID compliant shall be ten dollars, and this fee shall be exempt from

1 the contributions specified in this Paragraph.  Five dollars and sixty-three cents of
2 the fee shall be paid to the Louisiana State Police Retirement System Fund.  One
3 dollar and fifty cents of the fee shall be forwarded by the department to the litter
4 abatement account which is created within the Conservation Fund through the
5 provisions of R.S. 56:10(B)(15).
6	(6)  The fee for a Class "E" driver's license, or renewal of a Class "E" driver's
7 license, issued to bona fide residents of the city of New Orleans, except those
8 applicants updating this credential to comply with REAL ID standards shall be
9 twenty dollars and twenty-five cents, .  Notwithstanding any other provision of law
10 to the contrary, the fee for bona fide residents of the city of New Orleans updating
11 a Class "E"driver's license to become REAL ID compliant shall be ten dollars, and
12 this fee shall be exempt from the contributions specified in this Paragraph.  The
13 renewal date on the original license shall remain unchanged on the updated license.
14 three Three dollars and seventy-five cents of which the basic license fee shall be paid
15 by the department to the board of trustees of the police pension funds of the city of
16 New Orleans.  Three dollars and seventy-five cents of the basic license fee shall be
17 paid to the Louisiana State Police Retirement System Fund.  One dollar and fifty
18 cents of the basic license fee shall be forwarded by the department to the litter
19 abatement account which is created within the Conservation Fund through the
20 provisions of R.S. 56:10(B)(15).

22	B.(1)  Every applicant for a Class "A", "B", or "C" commercial driver's
23 license, or for a renewal of a basic Class "A", "B", or "C" commercial driver's
24 license, except for those bona fide residents of the city of New Orleans and
25 applicants updating this credential to comply with REAL ID standards, shall pay for
26 such basic license a fee of sixty-one dollars and fifty cents.  Notwithstanding any
27 other provision of law to the contrary, the fee for an applicant updating a "Class "A",
28 "B", or "C" driver's license to become REAL ID compliant shall be ten dollars, and
29 this fee shall be exempt from contributions specified in this Paragraph.  Sixteen

1 dollars and twenty cents of the fee shall be paid to the Louisiana State Police
2 Retirement System Fund.  One dollar and fifty cents of the fee shall be forwarded by
3 the department to the litter abatement account which is created within the
4 Conservation Fund through the provisions of R.S. 56:10(B)(15).
5	(2)  The fee for a basic Class "A", "B", or "C" commercial driver's license,
6 or for the renewal of a basic Class "A", "B", or "C" commercial driver's license,
7 issued to bona fide residents of the city of New Orleans, except those applicants
8 updating this credential to comply with REAL ID standards shall be seventy-six
9 dollars and fifty cents, .  Notwithstanding any other provision of law to the contrary,
10 the fee for bona fide residents of the city of New Orleans updating a Class "A", "B",
11 or "C" commercial driver's license to become REAL ID compliant shall be ten
12 dollars, and this fee shall be exempt from the contributions specified in this
13 Paragraph.  The renewal date on the original license shall remain unchanged on the
14 updated license.  fifteen Fifteen dollars of which the basic license fee shall be paid
15 by the department to the board of trustees of the police pension fund of the city of
16 New Orleans.  Fifteen dollars of the basic license fee shall be paid to the Louisiana
17 State Police Retirement System Fund.  One dollar and fifty cents of the basic license
18 fee shall be forwarded by the department to the litter abatement account which is
19 created within the Conservation Fund through the provisions of R.S. 56:10(B)(15).

25	(dd)(I)  Every applicant seventy years of age or older for a Class "D" driver's
26 license, or for the renewal of a Class "D" driver's license, except those bona fide
27 residents of the city of New Orleans and applicants updating this credential to
28 comply with REAL ID standards, shall pay for such basic license a fee of twenty-two
29 dollars and thirteen cents, which shall be the cost of the license.  Notwithstanding

1 any other provision of law to the contrary, the fee for applicants seventy years of age
2 or older updating a Class "D" driver's license to become REAL ID compliant shall
3 be ten dollars, and this fee shall be exempt from the contributions specified in this
4 Subsubitem.  The license shall expire on the anniversary of the birthday of the
5 applicant which is nearest to a date of six years subsequent to the issuing of the
6 license, unless revoked, canceled, or suspended.

8	(ee)  Notwithstanding any provision of law to the contrary, the fee for
9 applicants seventy years of age or older requesting to become REAL ID complaint
10 on a Class "E" driver's license shall be exempt from the contributions specified in
11 this Paragraph.  Five dollars and fifty-six cents of the basic license fee shall be paid
12 to the Louisiana State Police Pension and Retirement System Fund.  One dollar and
13 fifty cents of the basic license fee shall be forwarded by the department to the litter
14 abatement account which is created within the Conservation Fund through the
15 provisions of R.S. 56:10(B)(15).

2 Orleans shall be exempt from the contributions specified in this Paragraph Seven
3 dollars and fifty cents of the basic license fee shall be payable by the department to
4 the board of trustees of the police pension fund of the city of New Orleans.  Ninety-
5 two cents of the basic license fee shall be paid to the State Police Pension and
6 Retirement Fund.  One dollar and fifty cents of the basic license fee shall be
7 forwarded by the department to the litter abatement account which is created within
8 the Conservation Fund through the provisions of R.S. 56:10(B)(15).

basic license fees.  Requires the renewal date on the original driver's license to
remain unchanged on the updated driver's license.
Present law specifies that every applicant for a Class "D" driver's license, or for a renewal
of a Class "D" driver's license, except those bona fide residents of the city of New Orleans,
must pay a basic license fee of $42.75.  Specifies that $11.15 of the fee must be paid to the
La. State Police Retirement System Fund and $1.50 must be forwarded by the dept. to the
litter abatement account which is created within the Conservation Fund through the
provisions of present law.
Proposed law modifies present law by adjusting the driver's license fee for Class "D"
applicants updating this credential to comply with REAL ID standards from $42.75 to $10
and exempts the fee from the required contributions in present law applicable to the basic
license fees.  Further, requires the renewal date on the original license remain unchanged on
the updated license.
Present law specifies that the fee for Class "D" driver's licenses, or renewal of a Class "D"
driver's license, issued to bona fide residents of the city of New Orleans must pay $54.
Additionally requires that $15 be payable by the dept. to the board of trustees of the police
pension fund of the city of New Orleans.  Additionally, $1.84 of the fee be paid to the La.
State Police Retirement System Fund and $1.50 fee be forwarded by the dept. to the litter
abatement account which is created within the Conservation Fund through the provisions of
present law.
Proposed law modifies present law adjusting the driver's license fee for Class "D" applicants
that are bona fide residents of the city of New Orleans updating this credential to become
exclusively complaint with REAL ID standards from $54 to $10 and exempts the fee from
the required contributions in present law applicable to the basic license fees.  Further,
requires the renewal date on the original license remain unchanged on the updated license.

remain unchanged on the updated license.
Present law specifies that the fee for a basic Class "A", "B", or "C" commercial driver's
license, or for the renewal of a basic Class "A", "B", or "C" commercial driver's license,
issued to bona fide residents of the city of New Orleans must be $76.50.  Additionally,
requires $15fee be paid by the dept. to the board of trustees of the police pension fund of the
city of New Orleans and $15 be paid to the La. State Police Retirement System Fund. 
Further, requires $1.50 of the fee be forwarded by the dept. to the litter abatement account
which is created within the Conservation Fund through the provisions of present law.

Retirement System Fund and $1.50 of the fee be forwarded by the dept. to the litter
abatement account which is created within the Conservation Fund through the provisions of
present law.

applicants 70 years of age or older that are bona fide residents of the city of New Orleans
updating this credential to comply with REAL ID standards from $27.75 to $10.  Further,
requires the renewal date on the original license remain unchanged on the updated license.
Present law requires that $7.50 of the fee be payable by the dept. to the board of trustees of
the police pension fund of the city of New Orleans.  Additionally, requires ninety- two cents 
of the fee be paid to the State Police Pension and Retirement Fund and $1.50 of the fee be
forwarded by the dept. to the litter abatement account which is created within the
Conservation Fund through the provisions of present law.
Proposed law modifies present law by exempting bona fide residents that are 70 years or
older from the required contributions in present law when updating a Class "D" driver's
license to comply with the REAL ID standard by waiving the basic license fees for these
applicants.
