HOUSE BILL NO. 655

HEALTH/LDH:  Provides relative to fees charged by the Louisiana Department of Health
in parish health units
1	AN ACT
2To amend and reenact R.S. 40:31.36(A) through (C) and to enact R.S. 40:31.36(F), relative
3 to fees charged by the Louisiana Department of Health in parish health units for
4 certain healthcare services; to provide for maximum fees to be charged; to authorize
5 rulemaking; to provide for the manner of setting and posting fee schedules; and to
6 provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 40:31.36(A) through (C) are hereby amended and reenacted and R.S.
940:31.36(F) is hereby enacted to read as follows: 
10 ยง31.36.  Health unit fees
11	A.  The department shall charge and collect a ten-dollar administrative fee
12 an administrative fee not to exceed fifty dollars in parish health units for each
13 childhood vaccination visit by a patient whose other pediatric services are provided
14 outside of the department's system.
15	B.  The department shall charge and collect an administrative fee of twenty-
16 five not to exceed fifty dollars in parish health units for administering international
17 immunizations for foreign travel.  In addition, the patient shall be responsible for the
18 parish health unit's current cost of yellow fever, cholera, and typhoid vaccines.
19	C.  The department shall charge and collect a clinic service copayment fee
20 of five not to exceed twenty-five dollars per clinic service and five not to exceed

1 twenty-five dollars per pharmacy service, not to exceed ten for a maximum total of
2 fifty dollars per clinic visit, for each service performed at a parish health unit.  Such
3 fee shall not apply to visits paid for under Subsection A or B of this Section.

5	F.  The department may publish current fee schedules by promulgating rules
6 in accordance with the Administrative Procedure Act and shall post the current fee
7 schedule in each parish health unit and on the department's website.
8 Section 2.  This Act shall become effective upon signature by the governor or, if not
9signed by the governor, upon expiration of the time for bills to become law without signature
10by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
11vetoed by the governor and subsequently approved by the legislature, this Act shall become
12effective on the day following such approval.

Abstract:  Establishes the maximum fees that may be charged by the La. Dept. of Health
(LDH) at a parish health unit for certain healthcare services.
Present law directs LDH to charge and collect a $10 administrative fee in a parish health
units for each childhood vaccination visit by a patient whose other pediatric services are
provided outside of LDH's system. 
Proposed law increases the maximum amount that LDH may charge and collect for each
childhood vaccination visit by a patient whose other pediatric services are provided outside
of LDH's system to an amount not greater than $50.
Present law directs LDH to charge and collect an administrative fee of $25 in a parish health
unit for administering international immunizations for foreign travel.
Proposed law increases the maximum amount that LDH may charge and collect for
administering international immunizations for foreign travel to an amount not greater than
$50.
Present law authorizes LDH to charge and collect a clinic service copayment fee of $5 per
clinic service and $5 per pharmacy service, for a maximum total of $10 per clinic visit  for
each service performed in a parish health unit. 
Proposed law authorizes LDH to charge and collect a clinic service copayment fee not to
exceed $25 per clinic visit and not exceed $25 per pharmacy service, for a maximum total
of $50 per clinic visit, for each service performed in a parish health unit.

Proposed law provides that LDH may publish a current fee schedules by promulgating
administrative rules and LDH shall post the current fee schedule in each parish health unit
and on LDH's website. 
Effective upon signature of governor or lapse of time for gubernatorial action.
