MEDICAL MARIJUANA: Provides relative to fees collected by the Louisiana Department
of Health related to the sale of therapeutic marijuana
1 AN ACT
2To amend and reenact R.S. 40:1046(G)(1)(b), relative to fees collected by the Louisiana
3 Department of Health for therapeutic marijuana; to require the Louisiana Department
4 of Health to collect an annual fee from retail permit holders authorized to sell
5 therapeutic marijuana; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:1046(G)(1)(b) is hereby amended and reenacted to read as
8follows:
9 ยง1046. Recommendation and sale of marijuana for therapeutic use; production
10 facility licensing; regulations and permitting by the Louisiana Department of
11 Health

15 (b) Upon each annual renewal period, a retail permit in force shall be
16 renewed by the department for the next succeeding period upon proper application
17 for renewal and payment of permit fees as required by law and the rules and
18 regulations of the department. The department shall establish and collect an annual
19 permit fee of five thousand dollars from each retail permit holder.

Abstract: Requires the La. Dept. of Health to establish and collect an annual fee from a
retail permit holder authorized to sell therapeutic marijuana.
Present law requires the annual renewal of a retail permit to sell recommended marijuana
for therapeutic use. Present law requires the proper application and payment of fees as
required by the La. Dept. of Health (LDH).
Proposed law requires LDH to establish and collect an annual fee of $5000 from each retail
permit holder authorized to sell recommended therapeutic marijuana.
