HOUSE BILL NO. 663
BY REPRESENTATIVE FIRMENT
TAX/INSURANCE PREMIUM:  Provides for the disposition of certain state sales and use
tax collections for the purpose of fortifying residential roofs in the coastal zone
1	AN ACT
2To enact R.S. 47:302.57, relative to the disposition of certain sales tax collections; to
3 provide for the transfer, deposit, and use of such monies; to provide with respect to
4 the powers and duties of the Department of Revenue and the Department of
5 Insurance; to provide for promulgation of rules; to provide definitions; to provide an
6 effective date; to require reports to the legislature; and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1. R.S. 47:302.57 is hereby enacted to read as follows: 
9 ยง302.57.  Disposition of certain collections; Louisiana Fortify Homes Program
10	A.  There is hereby established in the state treasury as a special fund the
11 Fortify Coastal Homes Fund, hereafter referred to in this Section as the "fund".
12 Monies in the fund shall be invested in the same manner as monies in the state
13 general fund and any interest earned on monies in the fund shall be credited to the
14 fund. All unexpended and unencumbered monies in the fund at the end of the fiscal
15 year shall remain in the fund.  Monies in the fund shall be used in the same manner
16 as provided for in R.S. 22:1483.1 but shall only be used to issue grants within the
17 coastal zone.  After compliance with the provisions of Article VII, Section 9(B) of
18 the Constitution of Louisiana, the state treasurer shall deposit monies into the fund
19 from the following sources:
20	(1) Any monies transferred or appropriated to the fund by the legislature.

1	(2)  An amount equal to the lesser of either of the following from the state
2 sales and use tax imposed by the provisions of Chapters 2, 2-A, and 2-B of this
3 Subtitle collected in the coastal zone during the first two full months immediately
4 following a disaster declared pursuant to R.S. 29:724 for a natural disaster with an
5 emergency disaster area that incorporates any part of the coastal zone:
6	(a)  Five percent of such collections.
7	(b)  Sixty million dollars.
8	B. The Department of Revenue shall provide an annual report of any
9 collections and deposits made pursuant to this Section and the methodology used to
10 calculate the collections and deposits.  By February first each year the report shall
11 be submitted to the legislature in accordance with R.S. 24:772 and to the Department
12 of Insurance.
13	C.  As used in this Section, the term "coastal zone" shall mean both of the
14 following:
15	(1)  Each parish through which runs the inland boundary line of the coastal
16 zone as provided in Act 588 of the 2012 Regular Session of the Louisiana
17 Legislature.
18	(2)  Each parish that is geographically below the inland boundary line of the
19 coastal zone as provided in Act 588 of the 2012 Regular Session of the Louisiana
20 Legislature.
21	D.  The Department of Revenue and the commissioner of insurance may
22 promulgate rules pursuant to the Administrative Procedure Act for the
23 implementation and enforcement of the provisions of this Section.
24 Section 2.  The provisions of this Act shall become effective on July 1, 2026.

Abstract:  Establishes the Fortify Coastal Homes Fund ("fund") within the state treasury
and dedicates a portion of certain sales taxes collected in the coastal area after a
declared disaster to the fund.
Proposed law establishes the fund in the state treasury as a special fund and provides for the
deposit, investment, and use of monies in the fund.  Requires the treasurer to deposit into the
fund:
(1)Any monies transferred or appropriated to the fund by the legislature.
(2)An amount equal to the lesser of five percent or $60,000,000 of the state sales and
use tax levy collected in the coastal zone during the two months immediately
following a declared disaster pursuant to present law (R.S. 29:724) for a natural
disaster with an emergency disaster area that incorporates any part of the coastal
zone.
Proposed law defines the term "coastal zone" to mean each parish through which runs the
inland boundary line of the coastal zone as provided in Act 588 of the 2012 Regular Session
of the Louisiana Legislature and all land within state boundaries that is geographically below
this line.
Proposed law requires the Dept. of Revenue to provide an annual report of any collections
and deposits made pursuant to proposed law and the methodology used to calculate the
collections and deposits. Requires delivery by Feb. 1 each year to the legislature and the
Dept. of Insurance.
Proposed law authorizes the secretary of the Dept. of Revenue and the commissioner of
insurance to promulgate rules pursuant to the Administrative Procedure Act for the
implementation and enforcement of the provisions of this Section.
Effective July 1, 2026.
