1	AN ACT
2To amend and reenact R.S. 44:11.2(E)(1)(introductory paragraph) and (2)(c) and
3 (H)(introductory paragraph), to enact R.S. 44:11.2(A)(6) and (J), and to repeal R.S.
4 44:11.2(D), relative to the personal information of protected individuals; to provide
5 for protection of the personal information of district attorneys, assistant district
6 attorneys, and district attorney investigators; to provide for records of the office of
7 the secretary of state; to provide for an effective date; and to provide for related
8 matters.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 44:11.2(E)(1)(introductory paragraph) and (2)(c) and
11(H)(introductory paragraph) are hereby amended and reenacted and R.S. 44:11.2(A)(6) and
12(J) are hereby enacted to read as follows:
13 ยง11.2.  Limited access to personal information for protected individuals
14	A.  As used in this Section, the term "protected individual" shall mean:

16	(6)  A current or retired district attorney, assistant district attorney, or district
17 attorney investigator.

19	E.(1)  A protected individual, or the judicial administrator's office on behalf
20 of a protected individual identified in Paragraphs (A)(1) through (5) of this Section

1 or the Louisiana District Attorneys Association on behalf of a protected individual
2 identified in Paragraph (A)(6) of this Section, may request that a public body or third
3 party:

5	(2)  A request made under this Section shall:
6	*          *          *
7	(c)  Provide sufficient information to confirm that the requester is a protected
8 individual, and that a request made by the judicial administrator's office or Louisiana
9 District Attorneys Association certifies that a requester is a protected individual, and
10 no further information may be required to confirm that the requester is a protected
11 individual.

13	H.  A protected individual or, the judicial administrator's office, or the
14 Louisiana District Attorneys Association may bring an action for mandamus due to
15 a violation of this Section against a public body or third party for:

17	J.  Notwithstanding the provisions of this Section, an individual who is
18 recognized as a protected individual shall not be exempt from publication or removal
19 of his personal information from records publicly posted by the office of the
20 secretary of state.
21 Section 2.  R.S. 44:11.2(D) is hereby repealed in its entirety.
22 Section 3.  This Act shall become effective on February 1, 2026.

Abstract:  Provides for protection of the personal information of current and retired district
attorneys, assistant district attorneys, and district attorney investigators.
Present law provides protections for the personal information of protected individuals,
including a current or retired justice of the La. Supreme Court, a current or retired judge of

an appellate, district, family, juvenile, parish, city, or municipal court established under the
Constitution of La., a current or retired justice or judge of a federal court domiciled in the
state, a current or retired magistrate appointed by a state court, a current or retired U.S.
magistrate judge domiciled in the state, or a current or retired commissioner or hearing
officer of any district court in the state.
Proposed law retains present law and further includes current or retired district attorneys,
assistant district attorneys, and district attorney investigators as a protected individuals.
Present law protects the home address, home and mobile telephone number, personal email
address, social security number, driver's license number, federal tax identification number,
bank account numbers, credit or debit card number, license plate number or unique identifier
of a vehicle, marital record, date of birth, school or daycare of a child, or place of worship
of a protected individual and the employment location of a spouse, child, or dependent of
a protected individual.  Proposed law retains present law.
Present law authorizes a protected individual or the judicial administrator's office to request
that a public body or third party not publish the protected individual's personal information
and remove the personal information from any existing publication.
Proposed law retains present law and further authorizes the La. District Attorneys
Association to make such a request on behalf of a current or retired district attorney,
assistant district attorney, or district attorney investigator.
Proposed law provides that present law and proposed law do not apply to personal
information on records publicly posted by the office of the secretary of state.
Present law defines "public body" for purposes of the Public Records Law.  Proposed law
retains present law.
Effective February 1, 2026.

44:11.2(A)(6) and (J); Repeals R.S. 44:11.2(D))
