(gov sig) 1 AN ACT 2 To amend and reenact R.S. 11:1305(D)(2), relative to the State Police Retirement System; 3 to provide relative to the credit for out-of-state full-time law enforcement service; 4 to provide for the actuarial purchase of such credit; to provide for determination and 5 funding of the cost of the purchase; to provide for an effective date; and to provide 6 for related matters. 7 Notice of intention to introduce this Act has been published. 8 Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 11:1305(D)(2) is hereby amended and reenacted to read as follows: 10 ยง1305. Membership in pension and retirement system; credit for unclassified service 11 prohibited; exceptions 12 * * * 13 D.(1) * * * 14 (2)(a) Notwithstanding any provision of law to the contrary, any person 15 whose membership in this system begins on or before June 30, 2008, who has at least 16 ten years six months of service credit, in this system, and who was employed by 17 any law enforcement agency of the federal government or of any other state or of any Page 1 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 1 SLS 25RS-43 ORIGINAL 1 political subdivision of another state where such service is not creditable in any 2 public retirement or pension system, fund, or plan in this or any other state or of the 3 federal government, may purchase service credit in this system for such employment 4 by paying all actuarial costs of such purchase as determined by the retirement system 5 actuary, in accordance with R.S. 11:158(C) and as further provided in this Paragraph. 6 (b) To purchase credit for such service, the member shall apply to the system 7 board of trustees and furnish with such application information on the name and 8 address of each retirement or pension system, plan, or fund in which the member was 9 enrolled during the out-of-state or federal law enforcement employment, together 10 with the dates of such employment. The appropriate officer, trustee, or employee of 11 each system, plan, or fund or of the out-of-state or federal employing agency shall 12 certify the length of employment of the member and that the member does not have 13 retirement or pension credit for such employment which duplicates the service credit 14 being purchased in the system. 15 (c) The cost of such service credit shall be paid in a lump sum, or the member 16 may enter into an agreement with the board for installment payments, such 17 installments to be made within the time period approved by the board not to exceed 18 thirty-six months. 19 Section 2. The cost of this Act shall be funded with the employee payments required 20 by Section 1 of this Act. Any additional cost of this Act shall be funded with additional 21 employer contributions in compliance with Article X, Section 29(F) of the Louisiana 22 Constitution. 23 Section 3. This Act shall become effective upon signature by the governor or, if not 24 signed by the governor, upon expiration of the time for bills to become law without signature 25 by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If 26 vetoed by the governor and subsequently approved by the legislature, this Act shall become 27 effective on the day following such approval. DIGEST SB 1 Original 2025 Regular Session Price Present law provides that any person in the system with at least 10 years of service credit, with a membership that begins on or before June 30, 2008, previously employed in any law enforcement agency of the federal government, or of any other state or any political subdivision of another state where such service is not creditable in any public retirement or pension system, fund, or plan in this or any other state or of the federal government, may purchase service credit in the system for the employment by paying all actuarial costs of the purchase as determined by the system actuary. Proposed law changes the existing amount of service credit a person must have to purchase service credit from 10 years to six months and removes the membership enrollment start date condition. Effective upon signature of the governor or lapse of time for gubernatorial action.
