WEAPONS. Provides relative to the illegal carrying of weapons. (8/1/25)
1	AN ACT
2 To amend and reenact R.S. 14:95(A)(4)(a) and (M), 95.2(B)(3) and (C)(9), and 95.6(C)(1),
3 relative to the illegal carrying of weapons; to provide relative to definitions; to
4 provide relative to exceptions; and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 14:95(A)(4)(a) and (M), 95.2(B)(3) and (C)(9), and 95.6(C)(1) are
7 hereby amended and reenacted to read as follows:
8 §95. Illegal carrying of weapons
9	A. Illegal carrying of weapons is any of the following:

11	(4)(a) The intentional possession or use by any person of a dangerous weapon
12 on a school campus during regular school hours or on a school bus. "School" means
13 any elementary, secondary, or high school, or vo-tech school in this state and
14 "campus" means all facilities and property within the boundary of the school
15 property. "School bus" means any motor bus being used to transport children to and
16 from school or in connection with school activities.

2	M. The provisions of Subparagraph (A)(1)(a) of this Section shall not apply
3 to a resident of Louisiana if all of the following conditions are met:
4	(1) The person is twenty-one years of age or older.
5	(2) The person is not prohibited from possessing a firearm under R.S.
6 14:95.1, R.S. 40:1379.3(C)(5) through (17), 18 U.S.C. 922(g), or any other state or
7 federal law.
8	(3)(a) The person is a reserve or active-duty member of any branch of the
9 United States Armed Forces; a member of the Louisiana National Guard or the
10 Louisiana Air National Guard; or a former member of any branch of the United
11 States Armed Forces, the Louisiana National Guard, or the Louisiana Air National
12 Guard who has been honorably discharged from service.
13	(b) At all times that a person is in possession of a concealed handgun
14 pursuant to R.S. 40:1379.3(B)(2), that person shall have on his person proof that he
15 meets the qualifications of Subparagraph (a) of this Paragraph demonstrated by one
16 of the following:
17	(i) A valid military identification card.
18	(ii) A valid driver's license issued by the state of Louisiana displaying the
19 word "Veteran" pursuant to R.S. 32:412(K).
20	(iii) A valid special identification card issued by the state of Louisiana
21 displaying the word "Veteran" pursuant to R.S. 40:1321(K).
22	(iv) For a member released from service who does not qualify to have the
23 word "Veteran" displayed on a state issued driver's license or special identification
24 card, a Department of Defense Form 214 (DD-214) indicating the character of
25 service as "Honorable" or "Under Honorable Conditions (General)" and a valid
26 driver's license or special identification card issued by the state of Louisiana.

28	M. The provisions of Paragraph (A)(1)(a) of this Section shall not apply to
29 any person who is eighteen years of age or older and is not prohibited from

1 possessing a firearm under R.S. 14:95.1, 18 U.S.C. 922(g), or any other state or
2 federal law.

4 §95.2. Carrying a firearm, or dangerous weapon, by a student or nonstudent on
5	school property, at school-sponsored functions or firearm-free zone

7	B. For purposes of this Section, the following words have the following
8 meanings:

10	(3) "School" means any elementary, secondary, high school, vocational-
11 technical school, college, or university in this state.

13	C. The provisions of this Section shall not apply to:

15	(9) Any person who has a valid concealed handgun permit issued pursuant
16 to R.S. 40:1379.1 or, 1379.3, or by a state that has reciprocity with Louisiana, or
17 a person carrying a handgun pursuant to 14:95(M), and who carries a concealed
18 handgun within one thousand feet of any school campus.

22	C. For purposes of this Section:
23	(1) "School" means any public or private elementary, secondary, high school,
24 or vocational-technical school, college, or university in this state.

Present law provides that illegal carrying of weapons includes the intentional possession or
use by any person of a dangerous weapon on a school campus during regular school hours
or on a school bus. Present law defines "school" as any elementary, secondary, high school,
or vo-tech school.
Proposed law deletes vo-tech schools from the definition of "school" but otherwise retains
present law.
Present law provides that illegal carrying of weapons includes the intentional concealment
of any firearm, or other instrumentality customarily used or intended for probable use as a
dangerous weapon, on one's person, and provides an exception to present law for a person
with a valid concealed handgun permit issued pursuant to present law. Present law further
provides an exception for a person who is 18 years of age and not prohibited from possessing
a firearm under state or federal law.
Proposed law makes a technical change to present law but otherwise retains present law.
Present law prohibits carrying a firearm or other dangerous weapon by a student or
nonstudent on school property, at a school sponsored function, or in a firearm-free zone at
any time while on a school campus, on school transportation, or at any school sponsored
function in a specific designated area including but not limited to an athletic competition,
dances, parties, or any extracurricular activities, or within 1,000 feet of any school campus.
Present law defines "school" as any elementary, secondary, high school, vocational-technical
school, college or university.
Proposed law provides that present law does not apply to a person who has a concealed
handgun permit issued by a state that has reciprocity with La. for the lawful concealed carry
of a handgun or a person carrying a handgun pursuant to other present law.
Proposed law also removes vocational-technical schools from the present law definition of
"school" but otherwise retains present law.
Present law defines "school" as any elementary, secondary, high school, vocational-technical
school, college or university.
