WORKERS' COMPENSATION. Removes limitations on total amount of premiums
received by LWCC in any calendar year from operations in other states. (8/1/25)
1	AN ACT
2 To amend and reenact R.S. 23:1393(A)(2), relative to workers' compensation insurance by
3 the Louisiana Workers' Compensation Corporation to Louisiana employers with
4 operations in other states; to provide for the total amount of premiums received in
5 any calendar year from operations in other states; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 23:1393(A)(2) is hereby amended and reenacted to read as follows:
8 ยง1393. Creation of Louisiana Workers' Compensation Corporation
9	A.	*          *          *
10	(2) The corporation is authorized to provide workers' compensation insurance
11 which shall include but not be limited to state workers' compensation insurance
12 coverage, United States Longshore and Harbor Worker's Compensation Act
13 coverage, and Jones Act coverage. Such The coverage may be provided through any
14 direct insurance agreement or shared risk arrangement with entities that are properly
15 qualified by the Department of Insurance and maintain an "A" or better rating
16 according to the then current annual edition of Best's Insurance Reports. The
17 corporation is also authorized to provide such coverage for temporary and permanent

1 operations in other states to its insureds with exposures in Louisiana, provided that
2 the insured is domiciled in Louisiana, incorporated in Louisiana, or has its principal
3 place of business in Louisiana. However, the total amount of premiums in any
4 calendar year for coverage for temporary and permanent operations subject to other
5 states' laws shall not exceed twenty percent of the corporation's annual total amount
6 of premiums derived from workers' compensation insurance. No more than thirty
7 percent of the total premium for any insured shall be for exposures under other states'
8 laws.

Present law restricts the amount of total premium earned by the Louisiana Workers'
Compensation Corporation (LWCC) in any calendar year from operations in other states by
La. employers to not more than 20% of the total premiums earned by LWCC.
Present law also provides that no more than 30% of the total premium for any LWCC
insured may be for exposures under other states' laws.
Proposed law removes both restrictions.
