ENVIRONMENTAL CONTROL. Provides for sequestration of carbon dioxide. (8/1/25)
1	AN ACT
2 To amend and reenact R.S. 30:1105(C), relative to carbon sequestration; to provide for the
3 jurisdiction, powers, and duties of the commissioner of conservation; to provide for
4 public hearings, and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 30:1105(C) is hereby amended and reenacted to read as follows:
7 ยง1105. Hearings; notice; rules of procedures; emergency; service of process; public
8	records; request for hearings; orders and compliance orders

10	C. Any interested person has the right to have the commissioner call a
11 hearing for the purpose of taking action in respect to a matter within the jurisdiction
12 of the commissioner as provided in this Section by making a request therefor in
13 writing and paying the hearing fee set by the commissioner, as provided by law for
14 hearing conducted pursuant to R.S. 30:6. Upon receiving the request and payment
15 of the required fees the commissioner shall promptly call a hearing. After the hearing
16 and with all convenient speed and within thirty days after the conclusion of the
17 hearing, the commissioner shall take whatever action he deems appropriate with

1 regard to the subject matter. The commissioner shall give substantial
2 consideration to local government comments when determining the appropriate
3 course of action.

Present law grants any interested person the right to request a hearing before the
commissioner by submitting a written request and paying a fee, after which the
commissioner must promptly call a hearing and take appropriate action within 30 days of
its conclusion.
Proposed law retains present law and requires the commissioner to give substantial
consideration to local government comments when determining the appropriate course of
action.
