27	27	An Act relative to community behavioral health centers.
28	28	Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
29	29	of the same, as follows:
30	30	1 SECTION 1. Chapter 32A of the general laws, as appearing in the 2020 official edition,
31	31	2is hereby amended by inserting after section 30 the following new section:-
32	32	3 Section 31. (a) For the purposes of this section, the following words shall have the
33	33	4following meanings:
34	34	5 “Behavioral health bundled services”, services delivered by a community behavioral
35	35	6health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
36	36	7evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
37	37	8mental health, developmental or substance use disorder, provided that services are reimbursed
38	38	9through a flat rate per encounter.
39	39	10 “Community Behavioral Health Centers”, a clinic licensed by the department of public
40	40	11health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00. 2 of 5
41	41	12 (b) Any health plan offered by the commission shall provide to an active or retired
42	42	13employee of the commonwealth who is insured under the group insurance commission benefits
43	43	14on a nondiscriminatory basis for medically necessary behavioral health bundled services
44	44	15delivered through community behavioral health centers.
45	45	16 SECTION 2. Chapter 175 of the general laws, as appearing in the 2020 official edition, is
46	46	17hereby amended by inserting after section 47PP the following new section:-
47	47	18 Section 47QQ. (a) For the purposes of this section, the following words shall have the
48	48	19following meanings:
49	49	20 “Behavioral health bundled services”, services delivered by a community behavioral
50	50	21health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
51	51	22evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
52	52	23mental health, developmental or substance use disorder, provided that services are reimbursed
53	53	24through a flat rate per encounter.
54	54	25 “Community Behavioral Health Centers”, a clinic licensed by the department of public
55	55	26health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
56	56	27 (b) Any individual policy of accident and sickness insurance issued pursuant to section
57	57	28108, which provides hospital expense and surgical expense insurance, and a group blanket or
58	58	29general policy of accident and sickness insurance issued pursuant to section 110, which provides
59	59	30hospital expense and surgical expense insurance, which is issued or renewed within or without
60	60	31the commonwealth, shall provide benefits on a nondiscriminatory basis for medically necessary
61	61	32behavioral health bundled services delivered through community behavioral health centers. 3 of 5
62	62	33 SECTION 3. Chapter 176A of the general laws, as appearing in the 2020 official edition,
63	63	34is hereby amended by inserting after section 38 the following new section:-
64	64	35 Section 39. (a) For the purposes of this section, the following words shall have the
65	65	36following meanings:
66	66	37 “Behavioral health bundled services”, services delivered by a community behavioral
67	67	38health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
68	68	39evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
69	69	40mental health,
70	70	41 developmental or substance use disorder, provided that services are reimbursed through a
71	71	42flat rate per encounter.
72	72	43 “Community Behavioral Health Centers”, a clinic licensed by the department of public
73	73	44health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
74	74	45 (b) Any contract between a subscriber and the corporation under an individual or group
75	75	46hospital service plan which is issued or renewed within or without the commonwealth shall
76	76	47provide benefits on a nondiscriminatory basis for medically necessary behavioral health bundled
77	77	48services delivered through community behavioral health centers.
78	78	49 SECTION 4. Chapter 176B of the general laws, as appearing in the 2020 official edition,
79	79	50is hereby amended by inserting after section 25 the following new section:-
80	80	51 Section 26. (a) For the purposes of this section, the following words shall have the
81	81	52following meanings: 4 of 5
82	82	53 “Behavioral health bundled services”, services delivered by a community behavioral
83	83	54health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
84	84	55evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
85	85	56mental health, developmental or substance use disorder, provided that services are reimbursed
86	86	57through a flat rate per encounter.
87	87	58 “Community Behavioral Health Centers”, a clinic licensed by the department of public
88	88	59health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
89	89	60 (b) Any subscription certificate under an individual or group medical service agreement
90	90	61which is issued or renewed within or without the commonwealth shall provide benefits on a
91	91	62nondiscriminatory basis for medically necessary behavioral health bundled services delivered
92	92	63through community behavioral health centers.
93	93	64 SECTION 5. Chapter 176G of the general laws, as appearing in the 2020 official edition,
94	94	65is hereby amended by inserting after section the following new section 33:-
95	95	66 Section 34. (a) For the purposes of this section, the following words shall have the
96	96	67following meanings:
97	97	68 “Behavioral health bundled services”, services delivered by a community behavioral
98	98	69health center as specified in title 101 of the code of Massachusetts regulations 305.00 for the
99	99	70evaluation, diagnosis, treatment, care coordination, management, or peer support of patients with
100	100	71mental health, developmental or substance use disorder, provided that services are reimbursed
101	101	72through a flat rate per encounter. 5 of 5
102	102	73 “Community Behavioral Health Centers”, a clinic licensed by the department of public
103	103	74health and regulated pursuant to title 130 of the code of Massachusetts regulations 448.00.
104	104	75 (b) Any health maintenance contract issued or renewed within or without the
105	105	76commonwealth shall provide benefits on a nondiscriminatory basis for medically necessary
106	106	77behavioral health bundled services delivered through community behavioral health centers.
