2626 An Act relative to prohibiting billboard advertisements of non-prescription marijuana.
2727 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
2828 of the same, as follows:
2929 1 SECTION 1. Section 4 of chapter 94G of the General Laws, as appearing in the 2020
3030 2Official Edition, is hereby amended by striking in line 231 after the word "misleading;" the
3131 3following:-
3232 4 "(2) a prohibition on advertising, marketing and branding by means of television, radio,
3333 5internet, billboard or print publication unless at least 85 per cent of the audience is reasonably
3434 6expected to be 21 years of age or older, as determined by reliable, up-to-date audience
3535 7composition data"
3636 8 and inserting in place thereof the following:- ";(2a) a prohibition on advertising,
3737 9marketing and branding by means of billboards; (2b) a prohibition on advertising, marketing, and
3838 10branding by means of television, radio, internet, or print publication unless at least 85 per cent of
3939 11the audience is reasonably expected to be 21 years of age or older, as determined by reliable, up-
4040 12to-date audience composition data" 2 of 2
4141 13 SECTION 2. Said section 4 of said chapter 94G of the General Laws, as appearing in the
4242 142020 Official Edition, is hereby amended by striking in line 258 after the word "unless" the
4343 15following:- "at least 85 per cent of the audience is reasonably expected to be 21 years of age or
4444 16older, as determined by reliable, up-to-date audience composition data" and inserting in place
4545 17thereof the following:- "entry is restricted to those 21 years of age or older."
4646 18 SECTION 3. Said section 4 of said chapter 94G of the General Laws, as appearing in the
4747 192020 Official Edition, is hereby amended by inserting in line 265 after the word "a" the word
4848 20"conspicuous."
