2929 An Act relative to same day drug testing.
3030 Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority
3131 of the same, as follows:
3232 1 Chapter 118E of the General Laws, as appearing in the 2017 Official Edition, is hereby
3333 2amended by adding at the end thereof the following new section:-
3434 3 Section 78. Same Day Drug Testing – Presumptive and Definitive
3535 4 The Division of Medical Assistance shall ensure that current regulations, bulletins and
3636 5practices allow for definitive drug tests to be billed on the same day as presumptive drug tests
3737 6(drug screens) when medically necessary for managing a patient’s treatment in outpatient pain
3838 7management or substance abuse treatment settings. The policy shall be consistent with
3939 8American Medical Association and CMS HCPCS coding and may include but not be limited to 2 of 2
4040 9establishing preferred providers, setting educational requirements for providers and
4141 10differentiating among provider types.
