27 | 27 | | Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority |
---|
28 | 28 | | of the same, as follows: |

29 | 29 | | 1 SECTION 1. Section 47 of Chapter 118E of the General Laws, as appearing in the 2020 |
---|
30 | 30 | | 2Official Edition, is hereby amended by adding after the third paragraph the following new |
---|
31 | 31 | | 3paragraph:- |
---|
32 | 32 | | 4 Notwithstanding the provision of any general or special law to the contrary, every person |
---|
33 | 33 | | 5covered by the division of medical assistance, its contracted health plans, health maintenance |
---|
34 | 34 | | 6organizations, behavioral health management firms, and third-party administrators under contract |
---|
35 | 35 | | 7to a medicaid managed care organization or primary care clinician plan shall have access to the |
---|
36 | 36 | | 8standards and procedures established under sections 12, 13, and 14 of chapter 176O. Such |
---|
37 | 37 | | 9standards shall be administered and enforced by the office of patient protection established by |
---|
38 | 38 | | 10section 16 of chapter 6D. The executive office of health and human services and the division of |
---|
39 | 39 | | 11medical assistance shall request waivers from any federal laws or regulations that impede the |
---|
40 | 40 | | 12effective implementation of this act. |
